(21.5 x 16.5cm.) This is a preparatory sketch by Jones for his celebrated painting (Private Collection, USA) of Nelson in his cabin ahead of the battle of Trafalgar. Completed in 1854, the painting went on a public tour of the United Kingdom and Ireland, principally to promote its popular printed version by Ferdinand Jean de la Ferté Joubert. Known as a history painter, often of military scenes, Barker enjoyed similar success with his depiction of Nelson receiving the surrender of the San Josef at the Battle of Cape St Vincent.

Signed, dated and located on the back. Attached study by Jorge Gutiérrez-García and Martínez de Marañón. With vintage frame. Measurements: 121 x 190 cm; 145 x 222 cm (frame). This work can be considered one of the best works of Thomas Jones Barker in its genre, both for its great quality and large format and for its complex composition, with numerous characters, the mastery in all aspects (landscape, quality of the canvases, etc.) and, especially, for the work of the characters, close to portraiture. There is no doubt about the authorship: the style coincides with that of Jones Barker, as well as the subject (a historical genre scene), and the work is signed "T.J. Barker pinxit" and, on the back, "Thomas Jones Barker pinxit, London 1862". On the other hand, the back of the work also presents several details that corroborate its authenticity. First of all, the stamps of the house in charge of making the stretcher and the canvas, which correspond to those used by the author (C. Davy Artists, 83 Newman st.). The date of the work, 1862, corresponds to the period in which this firm was located in Newman Street, Oxford (1843-1862). At the bottom of the frame we note a legend belonging to the framing workshop, J.M. Hill, active in the mid-19th century. Other labels and legends also appear, all corresponding to the period. Finally it should be noted that this work was sold at Christie's London in 1983, identified as a work by Jones Barker without doubt. "The Bride of Lammermoor" is a historical novel by Sir Walter Scott, published in 1819. It narrates the tragic love story between Lucy Ashton and Edgar Ravenswood, and the author indicates that it is based on real historical events that took place in the 17th century. Son of the painter Thomas Barker, Thomas Jones began his training with his father, and from 1835 he continued it in Paris with Horace Vernet, with whom he remained for many years. During these years in France Jones Barker frequently exhibited his works at the Paris Salon, being awarded three gold medals. He also painted several pictures for Louis Philippe of France, among them "The Death of Louis XIV". For Princess Marie, daughter of Louis Philippe, Jones Barker painted in 1840 "The Bride of Death", for which he received the Cross of the Legion of Honor. The painter returned to England around 1845, and soon began to exhibit his works at the Royal Academy in London, mainly portraits. He also sent to this institution a work inspired by a poem by Sir Walter Scott, "The Troubadour" (1849). As the years progressed, Jones Barker continued to show his works regularly at the Royal Academy, with different themes as his career evolved (war, historical works, portraits...). Probably following Vernet's influence, Jones Barker's first works mainly dealt with themes of the Napoleonic wars. Towards the end of his life he returned to war themes with great critical and public success, depicting themes of the Franco-Prussian and Crimean wars. He is currently represented in the National Portrait Gallery in London, the National Army Museum, the National Museum of Wales, the National Gallery of Ireland, the Southampton Art Gallery and the Maidstone Museum, among other public and private collections.

The canvas is relined. There is a restored tear of appr. 4 x 6 cm in the upper right quadrant. Inspection under UV light reveals retouchings to the mentioned damage. The darker areas, especially concerning the suit of the sitter, are affected by stronger craquelee. The frame is in good condition with a few losses of material. The stretcher measures 122.5 x 86.5 cm and the frame 150.5 x 115 cm. Thomas Jones Barker (1815-1882) Thomas Jones Barker was a student of Horace Vernet in Paris, before settling in England to become a well-established history painter. In terms of style and motifs, Barker clearly followed his famous teacher Vernet. In addition to detailed battle scenes Barker also created genre scenes, and portraits. In 1870/71 Barker was present at the Franco-German front, where he was inspired to battle scenes. His works were exhibited at the Paris Salon from 1835 to 1845 and at the London Royal Academy from 1844 to 1876. Examples of his artistic output are today preserved, for instance, at the British Museum or the Manchester City Hall. The family also owned Chisholm House in the Scottish borders which was built in 1752 and is set in an estate of nearly 200 acres. It was once the seat of the head of the southern branch of Clan Chisholm but went out of the family possession in the early part of the 20th Century. Thomas Jones Barker is known as a portrait and military history painter. His first work to be exhibited at the Royal Academy of Arts was a scene from the Napoleonic Wars. He went on to paint, from the battlefields, the Franco Prussian War of 1870. He was a prolific portrait painter, in particular of Scottish famillies, but was also commissioned to paint Queen Victoria. His work can be found in public collections, including the National Portrait Gallery.

Ah, Woe, etc." ' CATALOGUE NOTE Barker's painting depicts the heroine Margaret (also known as Gretchen) from Goethe's Faust. After her brother Valentin is slain by Faust and Mephistopheles, Margaret flees to the cathedral for refuge, consumed by fear, shame and guilt. With his dying breath Valentin cursed his sister, renouncing her as a harlot and the cause of his death, having allowed herself to be seduced by Faust. In Barker's painting the ominous shadow of evil creeps across the wall behind the trembling Margaret as she kneels prostrate in the church. He whispers into her ear, mocking her terror as the choir sings the Dies Irae (Dance of Death) the Latin hymn describing the Day of Judgement. Dies iræ, dies illa, Solvet sæclum in favila Judex ergo cum sedebit, Quidquid latet adparebit, Nil inultum remanebit Quid sum miser tunc dicturus? Quem patronum rogaturus? Cum vix justus sit securus What shall I, a wretch, say? Day of wrath, day of wrath, On that day when the world shall dissolve in ashes So when the judge takes his seat, Whatever has been hidden will appear, Nothing shall remain unpunished Who shall I ask to plead for me, When scarcely the righteous shall be safe? Thomas Jones Barker had painted another scene from Faust in 1846 for the British Institution exhibition, entitled Faust and Margaret, with the accompanying Margaret's lines; 'Tis he! 'tis he! where now is all my pain, The anguish of the dungeon and the chain. 'Tis thou! thou com'st to rescue me!'. This picture (unlocated) illustrated a later incident in the story as Faust liberates Margaret from imprisonment. The same scene was the subject of various early drawings by Rossetti from 1848 (Tate and private collection) and endured as a popular subject throughout the nineteenth century. Lawrence Alma-Tadema and Simeon Solomon also painted early illustrations of the scene and as late as 1919, the Pre-Raphaelite follower Frank Cadogan Cowper painted the same incident.

            Nelson on the captured San Josef after the Battle of Cape St. Vincent, 14 February 1797 signed 'Thos. Jones Barker' (lower right) oil on canvas 61 x 109 in. (155 x 277 cm.) in the original gilded composition frame EXHIBITION London, Sotheby's, Rule Britannia!, 2 January - 29 January 1986, no. 93. NOTES On 1 February 1793, France declared war on Britain and Holland, signalling the start of a struggle of global dimensions which was to last almost twenty-five years. In 1796, the French invaded the north of Italy, and Spain made an alliance with the French republic. Nelson, at this time, had already been involved in important British actions against the French, at Corsica (where a shot had struck the gravel bank where he stood, driving debris into his right eye and destroying his sight in that eye, and in frustrating French movement and trade in the Gulf of Genoa. The Battle of Cape St. Vincent, fought on 14 February 1797, against the Spanish fleet was to show him as a man of quite exceptional ability and tactical brilliance. At a certain point in the battle, the English line had cut the Spanish fleet into two parts. Nelson, who was commanding the rear in the Captain, observed that the Spanish leading ships were bearing up so as to pass astern of the English line and regroup. He set the course of the Captain to obstruct their progress and engaged the largest ship then afloat, the Spanish flagship Santisima Trinidad, providing a delay which enabled other English ships to come up in support. The Captain suffered many losses in the engagement and Nelson, finding her unmanageable, laid her alongside the San Nicholas which he carried by boarding. The San Nicholas had itself fallen on the San Josef and Nelson therefore boarded the San Josef and took her surrender. This picture shows the captain of the San Josef presenting his sword to Nelson on the quarter-deck (the Admiral of the ship was below, mortally wounded). Nelson afterwards wrote of the occasion, 'I desired him to call to his first officers, and on the quarter-deck of a Spanish first-rate, extravagant as the story may seem, did I receive the swords of vanquished Spaniards, which, as I received, I gave to one my bargemen, who put them with the greatest sang-froid under his arm.' When the fighting was over, he boarded the Victory, where the Admiral of the British Fleet, Sir John Jervis, gratefully embraced him. In recognition of his conduct he was made a Knight Companion of the Bath and was promoted to the rank of Rear Admiral. SALESROOM NOTICE This lot is sold together with a booklet produced by Leggatt, Hayward & Leggatt to accompany the engraving of the present picture that they published on 10 November 1853. The booklet includes a detailed description of the Battle of St Vincent, a key identifying the sitters in the picture, and a plan showing the positions of the British and Spanish fleets during the engagement. The lot also includes a letter from Commander R.N. Knocker, dated 30 October 1949, describing a lithograph after the original oil painting that he examined in the Officers' Mess of the Welsh Regiment (previously known as the 69th Foot Regiment). The lithograph, framed with wood from the San Josef, was of particular interest to the regiment, as one of their members, Lieutenant Pierson, is depicted alongside William Fearney (one of Nelson's bargemen), who is taking the surrendered swords.
