Attributed to Aert van der Neer (Dutch, 1603/4-1677) A Landscape at moonlight with a village stream with figures and a church in the distance signed or inscribed in the lower centre in one monogram "AVDN" oil on panel h:42 w:63 cm Provenance: Etienne Le Roy/Brussels; Charles Sedelmeyer/Paris; Martin Rikoff, sale, Paris, 4 December 1907, No. 13 (Frs. 7,100) Anon. Sale, Stockholm (Bukowski) 5 November 1958, lot 247; Anon. Sale, London (Sotheby's) 11 March 1964, lot 77 (£1200) and thereafter Acquired by the present owner. Their Sale, London (Christie's) 9 July 1982, lot 56, when bought back. Literature: C. Hofstede de Groot, A Catalogue Raisonné of the Works of the Most Eminent Dutch Painters of the Seventeenth Century, vol. VII, 1923, pp. 421, no. 413 (as autograph); W. Schulz, Aert van der Neer, 2002, p. 410, cat. no. 1135, as "whereabouts unknown" and as "probably copy". Other Notes: When first published by Cornelis Hofstede de Groot in 1923, he indicated (as was his way) by printing the painting title in bold capital letters, that he had both seen the painting and considered it by the artist. In 1964 when the painting was auctioned by Sotheby's, it was catalogued by Neil MacLaren (1909-1988) the former Keeper and Curator of Dutch 17th Century painting at the National Gallery as autograph. In his own copy of Hofstede de Groot's 1923 catalogue he corrected and annotated the entry, including writing "overcleaned" but did not question the attribution. The late Wolfgang Schulz however in 2002, in stating its whereabouts was unknown, implies he had not seen it (unless he saw it earlier at the 1982 Christie's sale) and as he does not, in saying it is probably a copy, state after which original it is so, he possibly was implying it is an imitation.

Baron Etienne Martin de Beurnonville (d. 1881); (+) sale, Pillet, Paris, 9 May 1881, lot 394, as Aert van der Neer (sold 3,050 francs). Anon. Sale, Muller, Amsterdam, 30 November 1909, lot 37, as Aert van der Neer (sold to the present owner). LITERATURE C. Hofstede de Groot, A Catalogue Raisonn‚, etc., VII, London, 1923, p. 423, no. 423, as Aert van der Neer. W. Schulz, Aert van der Neer, Doornspijk, 2002, p. 398, no. 1076, present whereabouts unknown, 'authentic or copy'. NOTES Another work sold in the 1876 Lippmann von Lissingen sale ( Interior of a Dutch House by Pieter de Hooch now in the Museum of Fine Arts, Boston) was acquired there by Sedelmeyer, who subsequently either sold it to, or acted on behalf of, the Baron de Beurnonville; it would seem likely that the present painting passed into that collection in the same manner. De Beurnonville was a collector of some acuity, owning - in addition to the de Hooch - works by such artists as Gerard David, Rogier van der Weyden, Rubens, Ruisdael, Terborch, Fragonard and Chardin, all in public collections today, as well as Van der Neer's Evening landscape with a horse and cart by a stream in the National Gallery, London.

LITERATURE Connoisseur, October 1961 (recorded in the files of the Witt library). NOTES We are grateful to Dr. Wolfgang Schulz, and to Mrs. Marijke de Kinkelder of the R.K.D., for independently confirming the attribution to Van der Neer on the basis of photographs. Dr. Schulz, who notes that the painting seems on the basis of a photograph to be 'an authentic work by Aert van der Neer with some weaknesses in the right half', will include the picture in his forthcoming monograph and catalogue raisonn‚ of the artist's works, to be published by Doornspijk this year, as no. 958.

A frozen winter landscape with figures playing Kolf, a village nearby signed with double monogram 'AV DN' (lower left) oil on panel 81/2 x 93/4 in. (20 x 24 cm.) PROVENANCE Mme. Jules Ferry, Paris. with F. Kleinberger, Paris. Marcus Kappel, Berlin, by 1914; his sale, Cassirer and Helbing, Berlin, 25 November 1930, lot 12. Hofstede de Groot, A Catalogue Raisonn‚, etc., London, 1923, VII, p. 440, no. 487. NOTES The present painting was previously in the collection of Marcus Kappel, who amassed an extraordinary group of Dutch and Flemish pictures including Rubens' Portrait of Isabella Brandt, now in the Cleveland Museum of Art, Rembrandt's Self-Portrait, signed and dated 1669, in the Mauritshuis, The Hague and the Coastal landscape by Simon de Vlieger, lot 50 in the present sale. An annotation to the Marcus Kappel 1930 sale catalogue in the Frick Art Reference Library suggests that only five of the paintings were sold at the auction, with the remainder, including the present work, possibly returned to the heirs. SALESROOM NOTICE The present lot will appear as no. 76 in Dr. Wolfgang Schulz's forthcoming catalogue raisonn‚ on Aert van der Neer, scheduled to be published in 2001.
