Konkret wandte sich Grotius dabei gegen die Politik des "Mare clausum", mit dem Portugal seinen Überseehandel, vor allen mit den Ostindischen Kolonien monopolisieren wollte. -- -- Der englische Universalgelehrte, Jurist und Theologe, John Selden (1584-1654), wandte sich vor allem aus nationalistischen Beweggründen gegen die Theorien des Hugo Grotius, die er auch theologisch begründete. Vor dem Hintergrund des Erstarkens der englischen Nation im internationalen Seehandel führte der Absolutheitsanspruch zu immer weiterer Macht, die bekanntermaßen aus den Siegen von 1588 hervorging. So fordert der englische Kronjurist die Hoheit des Vereinigten Königreichs über alle seine umgebenen Meere. Sein "Mare clausum" war bereits 1618 vollendet worden, erschien aber erst 1635. Nicht bei Kress und Goldsmiths. – Zweite Ausgabe, erschienen im Jahr nach der Erstausgabe, die 1635 in London herausgebracht wurde und in sich der Jurist, Historiker, Philosoph und Universalgelehrte John Selden (1584-1654) auf die bedeutende Schrift "Mare Liberum" des Hugo Grotius antwortet. Grotius hatte in seinem 1609 publizierten Traktat für die weitestgehende Handelsfreiheit und die Öffnung der Weltmeere plädierte, in favorem vor allem der spanischen und portugiesischen Kaufleute, wohingegen Selden sein Postulat eines "Mare clausum" setzt. Vor dem Hintergrund der erstarkenden Vorherrschaft Englands auf den Weltmeeren, sollten die britischen Märkte geschützt werden. Verfasst hatte Selden das Werk schon 1618, konnte es aber erst 1635 drucken lassen. John Selden war als Abgeordneter des Parlaments und galt als Verteidiger der Freiheiten gegen die Staatsraison und die Monarchie. Zum Zeitpunkt der Abfassung seines Werks befand er sich nach mehreren Monaten Haft auf Bewährung, ohne dass Anklage gegen ihn erhoben worden war. König Karl I. gewährte ihm die Freiheit, nachdem Selden den vorliegen Traktat abgefasst hatte. – Vereinzelt wenige Stockfleckchen, minimale Wurmspuren, sehr schönes, zeitgenössisch gebundenes Exemplar.

In the Theanthropos, Selden tries to prove the date of Christ's birth by examining the history of it's celebration and its relation to the winter-solstice festival of the ancients. Elliott remarks: "Naturally, Selden was no more successful than others in proving the unprovable ... And Selden recognized, with considerable accuracy, that the authority for keeping Christmas on this day stemmed from 'about 400 years after our Saviour.' All in all, as good an answer to the Puritans' objection to the date of Christmas as was possible" (Grolier/Elliott). Table-Talk was compiled by his secretary Richard Milward, apparently before 1658, and first printed posthumously in 1689. The content was unacceptable to the restored monarchy which probably explains why it had not appeared before. The text had been widely circulated in manuscript form and it is apparent that later editors drew on these manuscript versions. Elliott points out that "Here Selden no longer bothers to rebut the Puritans. Indeed, in a short passage (p. 30), he recognizes a relationship between his contemporary Christmas and old-time pagan festivals, as well as Christmas traditions..."

Both Tillesley and Montague, the latter a considerable scholar who had edited one of the books published at Sir Henry Savile's Greek press at Eton, and joined the lists against Baronius, were firm believers, as good clergymen, that tithes were theirs by divine right. Tillesley, who pays some attention to the legal evidence, quotes only in Latin, whereas the Etonian bishop's work is heavily larded with Greek.

Note: Moule 131; STC 22178. First published in 1614 after his call to the Bar, this second enlarged edition begins with a eulogy by Ben Jonson. In the first part he deals with the titles and dignities of emperors, kings, and other rulers, beginning with the inquiry whether there were kings before the flood. In the second part he deals with inferior titles, commencing with those of heirs-apparent to thrones; and finally discusses feminine titles, honorary attributes such as ‘clarissimus’ and ‘illustris,’ and the laws of precedence. (DNB). It established itself as an indispensable classic in the field.
