General Rules

Galerie Kodl, s.r.o., with its registered seat Prague 6, Pato?kova 5, ID No.: 48108847, VAT:CZ48108847 (hereinafter referred as "Auctioneer") performs the auction on request of the owners of the auctioned items.
The auction is divided into 2 blocks. All the auctioned items are posted on the website www.galeriekodl.cz in the section "current auction". First round of the auction begins on the date and time stated in the auction catalogue. The lowest bid (starting price) is published in the auction catalogue. First round of the auction, which is a charitable auction, is carried out according to the information stated in the auction catalogue. The person authorized to perform the auction is entitled anytime during the auction, no later than 10 minutes after the calling up of the last auctioned item of the second part of the auction to return into the auction any of the auctioned items which weren't successfully auctioned.
Those interested in participating in the auction shall register when coming to the auction by presenting the identity card, passport or other identity papers and they will receive after approval of the registration by the Auctioneer an auction number under which they will make a bid on auctioned items. The auction is private, accessible only to customers of the Auctioneer and other people agreed. The Auctioneer is entitled without giving any reason to refuse the participation of those interested in the auction; there is no legal claim to registration or participation in the auction. The Auctioneer is entitled to require a security as a condition of the bidder's participation in the auction of the auctioned item. The amount of the security is then 20% of the starting price of the auctioned item, unless stated otherwise in the auction catalogue.
The auctioned items are identified and described including the starting price in the auction catalogue and the integral part of this auction notice. Information about the auctioned items and about the rights and obligations related to them are stated only according to the available information and the Auctioneer shall not be liable and responsible for their correctness and completeness. Damage corresponding to the usual wear and tear of the auctioned items with respect to their age and character is not stated in the catalogue. Any complaints about the items personally auctioned in the
auction house will not be accepted by the Auctioneer; complaints about the items auctioned based on the power of attorney granted to the Auctioneer can be made by the auction winner no later than during the takeover of the auctioned items.
The auction winner is the bidder who made the highest valid bid. The validity of the bid is considered by the person delegated by the Auctioneer. The auction provision of 20% including VAT is added to the auctioned price which is rounded to whole of CZK 50 upwards (hereinafter referred as "price"). The auction winner is obliged to pay the price immediately during the next payment break in cash if the amount of this transaction is lower that the limit in the amount of 250.000 CZK set because of the obligations from the Act No. 254/2004 Coll., concerning the limitation of cash payments (hereinafter referred as "limit"), eventually by card, otherwise the auction is invalid. If the amount of the transaction is higher than the limit and the auction winner doesn´t pay the price by card on the spot, the auction winner is obliged to pay an advance payment in cash on the spot in the amount of the auction provision (but up to the limit) (hereinafter referred as "advance payment") and pay the price after deduction of the paid advance payment via bank transfer to the Auctioneer's account no longer than within 10 days after the auction. The Auctioneer will issue a confirmation of payment including
the acknowledgement of the payment of the auction provision to the auction winner after the proper and complete payment of the price (hereinafter referred as "confirmation"). In case that the auction winner pays the whole price in
the above stated period, the ownership of the auctioned items is transferred to him from the moment of the bid. In case that the auction winner doesn´t pay the whole price, the auction is invalid, the auction winner doesn´t become the owner of the auctioned item and the Auctioneer is entitled to demand on the auction winner the penalty in the amount of the auction provision while being entitled to set off the penalty against the advance payment paid by the auction winner. By payment of the penalty the Auctioneer's claim for damages in the full amount is not affected.
In case that the auction winner is obliged to pay the price of the auctioned item at the place of the auction in cash or by credit card and he doesn´t do so during the next payment break after the auction of the item, the Auctioneer is entitled to
return this item back into the auction during the next part of the auction. The individual parts of the auction (including their termination time) are listed in the catalogue.
The bidder is entitled to make a bid even in his/her absence if the bidder grants the Auctioneer the verified written power of attorney to represent the bidder during the auction and if the bidder defines the items which the Auctioneer shall bid for
him and if the bidder determines the limit up to which the Auctioneer is entitled to make a bid for each item separately. To make a bid on phone is possible after the previous written agreement with the Auctioneer. The power of attorney for representation in the auction is available for download at www.galeriekodl.cz and are also the integral part of the catalogue.
If the auction winner pays the whole price, the auctioned items will be handed over immediately after his payment of the whole price on the spot or after providing the "confirmation" in the Auctioneer's premises, Gallery Kodl, Národní 7,Prague 1, 110 00, no longer than 14 days after the auction unless otherwise agreed. In case of delay with taking over of the auctioned item by the auction winner, the Auctioneer is entitled for payment of the storage fee of 200 CZK for each commenced day.
The risk of damage of the auctioned item shall pass to the auction winner from the moment of ownership transfer. The auction winner acknowledges that after the termination of the auction the auction items aren´t covered by the Auctioneer's insurance and in case of damage of the auctioned item is aware of this fact.
During the auction is forbidden to make sound, video or audio-video recording, including photography.
The participants in the auction agree to comply with this Auction Notice. The legal relationship associated with this auction are governed by the Czech legal order. In case of any dispute, the jurisdiction of the Czech courts shall be stated.
