Harris Estate Services, LLC - Terms & Conditions - Timed Auctions
1. GENERAL: ALL SALES ARE FINAL and all lots are sold as shown and "AS IS," with all faults, imperfections, and errors of description. Harris Estate Services, LLC, their employees and/or agents are not responsible for errors or omissions in description, genuineness or authenticity, and fault or defect in any lot. No warranties or representations whatsoever are given by Harris Estate Services, LLC, its employees and/or agents, to any buyer in respect to any lot. While Harris Estate Services, LLC, its employees and representatives, make every effort to accurately describe all lots offered for sale, it is incumbent upon the bidder to satisfy themselves in all areas of authenticity, originality, condition and imperfections. Bidders should also acknowledge that condition descriptions are often subjective and any item offered at auction may be subject to normal wear consistent with age that may not be specified in a condition description. Please contact us for a condition report if the information on the listing is not sufficient to answer your questions. Harris Estate Services reserves the right to add or delete items throughout the auction. Items sold at timed auctions must be picked-up at the assigned time, No Exceptions. Items to be shipped will be subject to 'Shipping.' See below.
2. PREVIEW of ITEMS: A preview period will be held for this auction. See the section titled "Specific Information for this Auction" for details. You may also contact us via Invaluable to ask for a condition report.
3. BUYER'S PREMIUM: A buyer's premium of 15% shall be added to each purchase to reach the total sales price according to the following table.
4. SALES TAX: Purchases by bidders that live within the boundaries of South Carolina are subject to the collection of state and local sales taxes. Unless an item is exempt by SC law, SC sales tax of 6% will be charged based on the total of the winning bid + buyer's premium and shown on the invoice for SC residents. For sales tax exemption the buyer must provide Harris Estate Services, LLC with a valid South Carolina Retail License Number and properly completed ST-8A Certificate of Exemption.
5. FORMS of PAYMENT: Acceptable forms of payment are Visa, MasterCard, Discover, and Paypal. If you wish to use Paypal, please notify us before the auction ends. No cash, checks, money orders or other forms of payment will be accepted unless previous arrangements have been made via a bank letter of approval.
6. INVOICING and PAYMENT COLLECTION: Complete payment is required immediately after you receive an invoice. You will receive your invoice immediately after the auction ends. You must contact us immediately after receiving your invoice to provide payment information. If you have indicated Paypal to us, we will send you an invoice via Paypal and you will need to make payment by Paypal before your item can be picked up or shipped. Item(s) not paid for by the end of the third day after bidding on the lot has closed are deemed noncollectable. The item(s) will be resold.
7. ITEM PICK UP: Paid items must be picked up at the date, time and place noted in the section entitled "Specific Information for this Auction" associated with each lot. Please note that we require one day to process invoices and collect payments for timed auctions. Your items will be released as soon as payment clears.
8. SHIPPING: Harris Estate Services, LLC does not ship any merchandise we sell at auction. Since we do not ship, we also do not bill you for shipping. If you are not able to pick up your item and require your item to be shipped to you, we will be pleased to cooperate with a third party shipper at your request. Your items will be released to the shipper as soon as payment clears and after you e-mail us requesting us to release your item(s) to a third party shipper. At your request, we can recommend local shippers that will provide services and bill you directly. Our recommended UPS shippers will ship small items such as coins, jewelry, etc. by US Postal Service at your request. They will also waive the insurance costs for items of lower value upon your approval. Our third party shipper is able to ship to you at a more economical rate than we can provide.
9. REMOVAL of PROPERTY: All property must be removed from the sale premises by the purchaser at their expense no later than 5 business days following its sale and, if property is not removed, Harris Estate Services, LLC reserves the right to charge a minimum storage fee of $5 per lot per day or to deliver said property to a public warehouse for storage at the purchaser's expense. Harris Estate Services, LLC shall have no liability for any damage to property left on its premises or on the sale premises for more than 5 days following the end of auction.
10. WINNING BIDDER: The highest bidder shall be the buyer. The record of sale, as kept by the auctioneer, will be taken as absolute and final in all disputes between two or more bidders. The auctioneer will determine the winning bidder and the auctioneer's decision will be binding and final.
11. RESERVES: Most lots are offered without reserves, however, a few lots may be offered subject to a reserve. A reserve is a confidential minimum price below which such a lot will not be sold.
12. BIDDING: All items are sold by online timed auction only. Harris Estate Services, LLC is not responsible for internet connection problems or website issues that cause missed bids. Timed auction bidders who desire to make certain their bid is accepted should use the maximum bid (automatic bid) feature of the timed auction system and leave their maximum bid at least 24 hours before the auction ends. The auction end time for a specific lot will be extended if that lot receives a bid very near to the end of the bidding period for the lot.
13. AGREEMENT TO TERMS and CONDITIONS: Your bidding at this Auction indicates that you have read and accept these Terms & Conditions of Sale.
