The auctioneer auctions in the name of and for the account of the client.

The auctioneer reserves the right to combine or separate the catalog numbers and, in certain special cases to offer an item out of sequence or withdraw it.

All of the objects that are to be auctioned can be viewed and inspected prior to the auction. The items are used. The auctioneer does not assume liability for deficiencies; he consents, if possible, to relay timely and justified notices of defects regarding the acquisition to the client within the statutory period of allowance.

Award

A tender is accepted, when no higher bid is given after three calls. The auctioneer as the representative of the client can reserve the right to accept or reject the bid. When more than one person simultaneously make the same bid and a higher offer is not made after three calls, then casting lots determines the acceptance. The auctioneer is authorized to withdraw a given acceptance and to offer the item again, if by mistake a higher timely bid was overseen or if there is otherwise doubt concerning the acceptance (§2 Ziffer 4 VerstV).

The acceptance is an obligation to purchase. With the granting of acceptance the possession and danger of the auctioned item are immediately conveyed to the purchaser, it becomes the bidder´s property after receipt of complete payment.

The auctioneer can collect and sue for the purchase costs, arrears as well as any ancillary service in his own name. The seat of the auctioneer is the place of jurisdiction as well as the place of fulfillment of all of the purchaser´s obligations.

The purchaser accepts the auctioning conditions by making a bid (in advance or live) or by giving a written order. Written bids must arrive at the auctioneer at least 24 hours before the auction.

Buyer´s Premium

The buyer´s premium is 22% + 3% (+ VAT) plattform charge. Both include the German taxe.

Payment conditions

The purchase money and the buyer´s premium of 22% + 3% plattform charge are to be paid directly in cash/bank wire/credit card to the auctioneer after the acceptance has been given to the purchaser.

Invoices issued during or directly after the art auction require a special verification and perhaps correction due to an overload of the accounting department. Errors excepted.

If payment is not made immediately to the auctioneer or the delivery of the item granted acceptance is refused, the transaction does not take place; on the contrary the purchaser forfeits his acceptance rights and the object is auctioned again at his costs. In this case the purchaser is liable for the deficit, on the other hand he is not entiteled to any additional proceeds and will also not be allowed to make a further bid.
