MISSION STATEMENT- It is our goal to sell unusual and high quality items at a fair market price in a fun and exciting environment. We hope you can someday visit our showroom. We think you will thoroughly enjoy the experience. This is also our first internet live auction. We will strive to make it a pleasurable experience for you.
TERMS AND CONDITIONS:
ALL ITEMS ARE SOLD AS IS!!!!!
BUYERS PREMIUM- There is a 15% buyers premium added onto the sales price on all internet auctions.
BUYERS REMORSE- We are good guys! If for any reason you are not satisfied, you have seven days to return the item. There will be a 25% restocking fee. This fee includes 25% of the selling price and the buyers premium. Items must be returned in the condition in which they left the premises. You are responsible for any and all costs in getting the item to you and in getting the item back to us.
QUESTIONS- Please ask all questions regarding items or procedures one day prior to the sale. We will not be answering questions the day of the sale.
REGISTRATION-All purchasers must register for a bidder's number and provide satisfactory identification and credit information.
BIDDING-Your bid is a contract. Place a bid only if you're serious about buying the item. The highest bid acknowledged by the auctioneer will be the purchaser. If you are the successful and winning bidder, you have entered into a legally binding contract to purchase the property bid on from the seller. You should contact the seller to resolve any questions before bidding. If the purchaser breaches any of its obligations under these Conditions of Sale, including its obligation to pay in full the purchase price of all items for which it was the highest successful bidder, the seller may exercise all of its rights and remedies under the law including, without limitation, (a) canceling the sale and applying any payments made by the purchaser to the damages caused by the purchaser's breach, and/or (b) offering at public auction, without reserve, any lot or item for which the purchaser has failed to pay in full the purchase price, holding the purchaser liable for any deficiency plus all costs of sale. In no event will the liability of the seller to any purchaser with respect to any item exceed the purchase price actually paid by such purchaser for such item.
DISPUTED BIDS-The auctioneer is the sole determinant as to the successful bidder. In the event that an in house floor bid and online bid are tied - the winning bid will go to the house floor bidder (even if the Ebay closed auction page shows you are the winner)
RESERVE BID-This is the price at which the bidding on a specific item will start. The item will be a "pass" if this minimum bid is not met.
ABSENTEE BIDS -- We will accept Absentee Bids as a convenience to clients who are not present at the auction. The office clerk will execute such bids competitively. It is entirely possible to buy items by absentee bid for less than your top bid price. Every effort will be made to execute all bids, however, you must know that we are new at this and the bugs have not necessarily been worked out!
PHONE BIDDING-We are not accepting phone bids the day of the auction at this time. They will, however, be treated like absentee bids.
PAYMENT- Seller will accept cash (inhouse only), check, Mastercharge and Visa. We do not accept PAYPAL at this time. The seller reserves the right to hold any item purchased with a check until the check has cleared the bank.
PICK UP AND GRACE PERIOD-Without prior arrangements, any item purchased must be removed from the premises within three days of purchase. There will be a storage fee equal to $2.00 per sq. foot per week to store item. Without prior arrangements, the item will be sold for storage fees after a 30 day period.
DESCRIPTION AND CONDITION-Any description or condition statement is given as a courtesy to a client and is only an opinion and should not be treated as a statement of fact. We are not the Antiques Road Show and all information supplied is given only as a layman's opinion. Although it is not our intention to mislead, the Randy Higbee Gallery shall have no responsibility for any error or ommission in the description or condition statement. We highly recommend you see the item in person! , Buyer agrees that in no event shall Randy Higbee Gallery be responsible for the correctness, description, genuineness, provenance, period, culture, source, origin, value or condition of any Lot.
MEASUREMENTS-We try to provide accurate measurements. They are always rounded up to the highest inch. If any measurements are crucial, please contact us.
ESTIMATES-High and low estimates are merely guidelines for the buyer.
ITEM WITHDRAWAL-The Randy Higbee Gallery reserves to withdraw any lot at any time from the auction for any reason.
SHIPPING-Buyer is responsible for arranging and paying for all shipping costs. We can not ship large items. Upon request, we will supply a list of shippers who possibly can. It is the buyers obligation to make any arrangements with these shippers. The Randy Higbee Gallery is not responsible for any damage incurred while shipping.
DELIVERY-We will deliver any item within the Los Angeles or Orange Counties for $75.00. This is curbside delivery and does not include getting the item inside your door. We will back a 15 foot high truck up as close as safely possible and set it your item(s) down from the power lift gate. From there and at that time, It is the buyers obligation to move the item to it's ultimate destination. The seller is not responsible for any damage done by the buyer in this moving process. It is the buyers responsibility to accomodate the seller in regards to delivery time. There will only be one delivery time offered by the seller. If the buyer cannot receive the item at that reasonable time, it will be the buyers obligation to arrange delivery.
SALES TAX-All items are subject to California State and Local Taxes governing the County of Orange unless a valid Resale Card is on file.
ACCEPTANCE OF TERMS- Bidding on any item indicates your acceptance of these terms and all other terms announced at the time of sale whether bidding in person, through a representative, by phone, by Internet, or other absentee bid.
REMEDIES-If Buyer fails to pay the Sales Price at the close of the auction or otherwise comply with these Terms and Conditions, the Randy Higbee Gallery shall be entitled to the following remedies: (1) to recover from Buyer any monetary loss arising on any resale of the Lot (including all costs of any resale or attempted resale); (2) to recover from the buyer any deposit or partial payment paid by Buyer: (3) to recover from Buyer all of its costs and expenses of collection, including attorneys fees of 30%(30%) of the outstanding balance, interest on the outstanding balance of 1.5% per month and all costs; and (4) all other relief and remedies allowed by the law. California law applies and jurisdiction and venue over all disputes involving these Terms and Conditions shall be in Orange County, California.
