Conditions of Sale:
The following Conditions of Sale for Estates Unlimited, Inc. Auctions and the Consignor's entire agreement with the buyer relative to the property listed in this catalogue. The Conditions of Sale and all other contents of this catalogue are subject to amendment by us by posted notices and/or oral announcements made prior to or during the auction. By participating in this sale, you acknowledge that you are bound by these terms and conditions.

18% Buyer's Premium


1 - All lots are guaranteed genuine, as described, for the period of 30 days of date of sale. Any dispute as to authenticity, must be made within thirty days of the sale date. All such disputes as to authenticity must be accompanied by a written opinion by an acknowledged expert in the field. After that period, all sales will be considered final. All returned lots must be adequately insured against loss or damage and must be returned to us in the same condition as when received. Prompt payment and pick-up is recommended to avoid late return situations.


2 - For all In house, absentee, and phone bidders, a buyers premium of 15% will be added to the successful bid price and is payable by the purchaser as part of the total purchase price.




3 - We reserve the right to withdraw any property before the sale and shall have no liability whatsoever for such withdrawal.


4 - We reserve the right to reject any bid. The highest bidder acknowledged by the auctioneer will be the purchaser. In the event of any dispute between bidders, the auctioneer will have the final discretion to determine the successful bidder, cancel the sale, or to re-offer or the sell the article in dispute. If any dispute arises after the sale, our sale record is conclusive. Although in our discretion we will execute order or absentee bids or accept telephone bids as a convenience to clients who are not present at auctions, we are not responsible for ANY errors or omissions in connection therewith.


5 - If the auctioneer decides that an opening bid is below the reserve for the article offered, he may reject the bid and withdraw the article from sale, and if, having acknowledged an opening bid, he decides that any advance thereafter is insufficient, he may reject the advance.


6 - Title to the offered lot passes to the buyer upon the fall of the auctioneer's hammer and the announcement by the auctioneer that the lot has been sold, subject to compliance by the buyer with the Conditions of Sale. The buyer assumes full risk and responsibility for the lot (including, without limitation, liability for or damage to frames, or glass covering prints, paintings or other works), and shall immediately pay the full purchase price. We reserve the right to impose from the date of sale a late charge of 1 _ % per month of the total purchase price if payment is not made in accordance with the conditions set forth herein. All property must be removed from our premises by the purchaser at his expense no later than three days following the sale, and, if it is not so removed we may send the purchased property to a public warehouse, at the risk and expense of the purchaser.


7 - No reserve will exceed the low presale estimate stated in the catalogue, or as amended by oral or posted notices. We may implement such reserve by opening the bidding on behalf of the Consignor and may bid up to the amount of the reserve, by placing consecutive bids for a lot, or bids in response to other bidders. In certain instances, the Consignor may pay us less than the standard commission rate where a lot is bought-in to protect its reserve.


8 - Unless exempted by law, the purchaser will be required to pay the combined Rhode Island State sales tax at 7% and local sales tax, any applicable compensating use tax of another state. Items shipped out of state are exempt.


9 - These conditions of Sale, as well as the purchaser's and our respective rights and obligations hereunder, shall be governed by and construed and enforced in accordance with the laws of the State of Rhode Island. By bidding at an auction, whether present in person or by agent, order bid, telephone or other means, the purchaser shall be deemed to have consented to the jurisdiction of the state courts of, and the federal courts sitting in, the State of Rhode Island.
