Midnight Sun Antique Auction Company or consignors make no guarantees stated or implied to the authenticity, attribution, reliability of description, or period of any item included in the auction. Please verify our descriptions and carefully study the property before you bid. Condition reports are subjective and are given only as an opinion and to help guide prospective buyers and should NOT be considered as a statement of fact. All dates & measurements given are an approximate guide.
All payments are due after fall of the hammer. Please be aware that the Auction house will still require credit card (unless previously on file with Auction House) which includes Buyer's Premium and any other applicable fees (unless cash wire transfer arrangements have been made). Late payments are subject to fees and penalties at the discretion of the Auction House. Payments unpaid or late will result in the account being sent to a collections agency. This can affect your overall credit scores for up to 7 years. Your bidder registration has been researched before approval for bidding at auction. The card provided on file was verified for identity purposes prior to approval. Lastly, chargebacks will be not accepted for any reason or on any purchase
Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidders responsibility to determine condition, age, genuineness, value or any other determinative factor. Midnight Sun Antique Auction Co. shall endeavor to describe in detail each item and any pertinent information about it. Midnight Sun Antique Auction Co. will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. Bidders agrees that everything is sold "as is" and that they may not return any item they purchase. Midnight Sun Antique Auction Co. is providing Internet pre-auction and live bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Bidders who leave absentee bids acknowledge that a maximum bid does not guarantee a winning bid. Under no circumstances shall Bidder have any kind of claim against Midnight Sun Antique Auction Co. or anyone else if the Internet service fails to work correctly before or during the live auction. Midnight Sun Antique Auction Co. reserves the right to withdraw or re-catalog items in this auction
All items will be sold in order of Lot Number. No Lot Number may be transferred to another Buyer
Bidders are solely responsible for their winning items once the Auctioneer declares them "sold" . If the occasion arises, the Auctioneer may use his/her discretion and "pass" on an item if he/she feels an item has not received an adequate bid. We, as the Agent for the consignors, must also protect their interests. Consignors are not allowed to bid on their own property.
Midnight Sun Antique Auction Company reserves the right to withdraw any item at any time before the Sale or to reject a bid from any source from any bidders at any time.
PAYMENTS: All purchases are to be paid for at the end of the Sale. Online bidders will need to furnish Credit Card information. Credit cards on file will be charged 4 days after Sale unless arrangements are made otherwise Online bidder will be charged for shipping separately on same credit card unless other arrangements have been made. Added verification will be made if credit card billing address or name is a mismatch. Third Party Buyers will be responsible for payment of total invoice.
We accept Visa / Mastercard / Discover/Amex & cash/bank Wire Transfer & Paypal. All bidders agree to pay a Buyers' Premium of 20% on the hammer price of successful bids. This is payable by the buyer as part of the total purchase as follows. There is no extra charge for credit card purchases. Online bidders who are bidding in an online bidding venue will pay 20% Buyer's premium as stipulated in the online terms and total payment will be charged to credit card on file. We will allow 15% Buyer's premium for any invoice sum over $5000 paid with cash or bank wire transfer only. Contact Auction House immediately after auction for any bank wire transfer requests.
SALES TAX: We are required by law to collect California Sales Tax which will be added to the total invoice (as of 2015 is 9.0 %) unless items are being purchased from out of the State of California. Resale exemption forms must be completed or Seller's permit and number must be submitted while registering or emailed for California residents requesting Sales Tax exemption.
SHIPPING, HANDLING & COLLECTION. Midnight Sun Antique Auction Company will provide handling, packing & shipping services. Bidders will be responsible for total cost of Shipping & Insurance charged on total purchase price to credit card on file (unless contacted after auction for special arrangements). All shipping costs will be at a competitive rate & shipped either Priority USPS, UPS, Fedex air determined by Auction House. Contact Auction House after 24 hours with special shipping requests or to arrange pick up. BEFORE BIDDING Please be aware for International shipping (outside of U.S.A.) of the country's customs requirements or limitations Winning bidders will be responsible for full payment irregardless of any shipping limitations incurred. Contact auction house with any inquiries.
All purchased items will be held for collection for 7 days & thereafter storage fees will be charged. Midnight Sun Antique Auction Company will ship item(s) no more than 10 business days after payment unless other arrangements made. We endeavor to give your items the utmost protection during the delivery process. Midnight Sun Auction Company will not be held responsible for any items damaged or lost in transit.
Payment
Payment becomes due on the completion of the sale. SIMON PARRS AUCTIONS LTD reserves the right to cancel the sales if no payment is made within 5 days of the auction ending.

Bank Transfer - SIMON PARRS AUCTIONS LTD banking details are available upon request. When transferring funds, please use the invoice number/title of lots as a reference.

We understand customers may not pay for many reasons. It may be that they have simply forgotten or not realised that they've won, lost their job when the invoice arrives or a multitude of reasons. But there is no excuse!! The buyer has agreed to the terms and conditions of the auction and any questions must be asked before the auction has commenced. Remember by not paying everyone is being affected. The consigner, the person below you that bid, the auction house and actually the buyer! As the buyer is likely to be blocked from many other auction houses for non payment. Would you being an auction house let someone in to bid who hasn't paid another auction house? If the item was offered to the underbidder at his bid price, how do we know that that is a fair price when at the end of the day the buyer ended up increasing the overall price and simply didn't pay. We review every customer and review customers feedback before allowing in a bidder. Don't forget most auction houses do this, so the more auction houses the buyer bumps off the likelihood is they won't get into other auctions. They agree to the terms and conditions and decide to pick and choose what items they are going to pay for or not pay for. It is also unfair to delay payment to as the consigner and the auction house is waiting for their money. We have implemented a 3 strike and you're out rule to this auction which means anyone who has over 2 strikes won't be allowed to bid. So simply any auction house you haven't paid make sure you do so. Be fair to everyone.
Shipping Terms
All items are shipped from California, USA. Midnight Sun Antique Auction Company will provide packing & shipping services (outside handling for oversize, fragile or heavy items) for majority of items. Bidders will be responsible for total cost of Shipping & Insurance charged on total purchase price to credit card on file (unless contacted after auction for special arrangements). Any shipping to different address from billing may need extra verification processes. All shipping costs will be at a competitive rate & shipped either Priority USPS or usually UPS (International except Canada will be shipped USPS insured if available) determined by Auction House. Handling fees are free UNLESS oversized/fragile special packing required. Contact Auction House after 24 hours with special shipping requests or to arrange pick up. BEFORE BIDDING please be aware for INTERNATIONAL of the country's Customs requirements or limitations Winning bidders will be responsible for full payment irregardless of any shipping limitations incurred. Also for International shipping, the Auction House will ship USPS express unless contacted by Bidder to insure & confirm tracking, or for oversized or higher valued items may have to be shipped using other services.
