Buying at David Barsby Auctions
ACCEPTANCE OF TERMS: Bidding on any item, whether in person, by absentee bid, or via a real-time internet auction, indicates the bidder's agreement to be bound by these Terms and Conditions.
TERMS OF SALE: Announcements made the day of auction take precedence over any previous communication. The auctioneer reserves the right to withdraw any lot at any time before its final sale and to reject any bid for any reason. The highest bidder for each lot, acknowledged by the auctioneer, shall be the "buyer". Any dispute that may arise as to bidding, or between two or more bidders, will be settled by the auctioneer and the auctioneer's decision will be final.
ESTIMATES: Pre-sale estimates are intended to be guides and may or may not reflect the actual selling price of a lot. MORTON AUCTIONEERS & APPRAISERS reserves the right to change estimates on any lot at any time.
RESERVES: Lots may be auctioned with reserve, and the auctioneer may bid on behalf of the reserve without further notice. Neither Consignors nor their agents, except as in the preceding sentence, are allowed to bid on their own items.
INSPECTION: All lots are available for inspection prior to the auction. We try to be as accurate as possible in our descriptions and measurements however, condition reports are always subjective and all dimensions should be considered approximate. We strongly urge you to make your own inspections. Responsibility rests with the buyer to assess the condition of any and all lots sold by MORTON AUCTIONEERS & APPRAISERS.
WARRANTIES AND DISCLAIMERS: All sales are final, with no returns or refunds. ANY AND ALL LOTS ARE SOLD "AS IS, WHERE IS" without any representations or warranties expressed or implied by MORTON AUCTIONEERS & APPRAISERS and/or the seller/consignor.
Catalogs, including on-line catalogs and brochures are intended as guides only, and are based on sources believed to be reliable, but whose accuracy cannot be guaranteed. INTERNET/ABSENTEE/PHONE BIDDING: Internet bidding may be available for certain auctions. BUYER'S RESPONSIBILITY: Upon the fall of the hammer, title to the offered lot shall pass to the buyer and the buyer immediately assumes full risk and responsibility for that lot, including liability for loss or damage.
CANCELLATION OF SALE: If purchased property remains in the custody of MORTON AUCTIONEERS & APPRAISERS for a period of 60 days or more following the auction, MORTON AUCTIONEERS & APPRAISERS may, at its discretion, cancel the sale retaining as liquidated damages any payments made by the buyer.

Contract
Your bid is a contract to buy. You must ask questions prior to your bidding. Condition reports are available up to 12 hours before the start of the auction
Buyer's Premium & Taxes
All lots are subject to a Buyer's Premium of 15% + GST (16.5% inclusive). All lots purchased using "Invaluable Live" online bidding system attract an additional 3% + GST (19.8% inclusive)

We accept the following methods of payment: Cash, Bank Cheque, Bank transfer, EFTPOS, MASTERCARD, VISA & AMEX. Transactions over $500 must be signed in person, ie no phone payments.
There is currently a surcharge of 3% for all payments by American Express. There is 1% surcharge for other credit cards.
Credit card payments over $500 can only be made in person with a PIN or signed transaction. If this is not possible then Bank transfer is required. MOTO is available for amounts under $500 at our discretion.
Packing and Shipping
Packing and Shipping
Buyers must arrange their own carriers for the removal of large items such as furniture. We are happy to recommend a number of local carriers. The buyer is responsible for any and all costs.
Small items, those suitable for carriage by Australia Post, can be packed and posted at the buyer's risk and expense. All items will be sent registered post and a modest charge will be added for time and postage materials.
All packages must be sent to the same address as your credit card is registered to.
Condition Reports
Condition Reports
These can usually be provided by our specialists on any lot, up to 24 hours prior to the commencement of the sale. Any questions regarding condition MUST be resolved to the buyer's satisfaction BEFORE leaving a bid. Due to the volume of pre-sale enquiries delays should be anticipated and response times will vary.
Condition reports should be considered opinion only and the purchaser should satisfy themselves as to whether or not in their own judgement, the lot accords with the description or indeed their expectations.
Digital Photographs
On request, we can email digital images of any lot up to 24 hours prior to the sale. We will ONLY respond to email requests for images and not verbal requests. Please email your request to: david@barsbyauctions.com.au
We reserve the right to not offer this complimentary service if the lot values are considered too low or if unreasonable demands are made of this service.
