JOSEPH BERNHARDT (1805-1850: THEOBALD GRAF VON BUTLER HAIMHAUSEN; AND VICTORINE GRAF VON BUTLER HAIMHAUSEN
Two oil on canvas, lined, Theobald inscribed 'Theobald Graf von Buttler Haimhausen/geboren den 19 Javer/803 gemale/von Jos Bernhardt/1838' on the reverse, Victorine inscribed 'Victorine Gräfin von Buttler Haimhausen/geborne/von Buedorfer geb-den 8th Decbr 1811/Jos Bernhardt pinx/1837' on the reverse. 50 x 37 1/2 in., 54 x 41 1/2 in. (frame).

Note: In the background of this portrait of the Countess Victorine Gräfin von Buttler Haimhausen there stands a white building. This structure is the Schloss Haimhausen, a castle built in Bavaria in 1281. It was destroyed in the Thirty Years War and rebuilt in 1660 as an ornate Baroque home. Francois Cuvillies enlarged the castle in the mid-18th century, adding Rococo plaster work and painting decoration in the chapel, banquet hall, and state apartments. The manor was purchased in 1794 by Count Buttler of Haimhausen. He and the Countess had ten children and took up causes for the poor and under-privileged. The castle had several owners, one of them James Eduard Haniel, a brewer, who turned the garden into an English style park, which it remains to this day. By the 1930s the castle had become too expensive to maintain as a family home. It is now the home of the Bavarian International School.

Terms and Conditions

It is important to Stair Galleries that all bidders understand the terms and conditions under which its auctions are conducted. Please carefully read the Conditions of Sale set forth below and then acknowledge your understanding and acceptance.

The property offered for sale by Stair Galleries & Restoration, Inc. (the "Gallery") as agent for the consignor(s) to purchasers is subject to the following terms and conditions:

1. The property is sold in "as is" condition and without recourse, and neither the Gallery nor the consignor makes any representations or warranties, express or implied, as to catalogue description, attribution, authenticity, provenance, origin, size, age or condition of any of the property offered for sale. It is the responsibility of the purchaser, prior to the auction, to examine the property and make a determination as to the value, condition, description, authenticity, provenance, origin, size and age of the property.

2. The highest bidder acknowledged by the auctioneer shall be the purchaser. The Gallery reserves the right to reject any bid. The auctioneer shall advance the bid at his/her sole discretion. The auctioneer in his/her sole discretion may determine to re-offer any lot in dispute. In the event of any dispute, the Gallery record of the bids shall be accepted as conclusive.

3. The Gallery reserves the right in its sole discretion at any time before bidding commences to withdraw combine or divide any lot.

4. At the fall of the auctioneer's hammer, title will pass to the highest bidder, and the bidder thereupon assumes full risk and responsibility for the property, including the obligation to immediately pay the full price or such price as the Gallery may require. All bidders may be requested to give their name, residence, business address, telephone number, driver's license and credit card. The Gallery shall have the right to reject any bid from anyone who has not established credit with the Gallery prior to the auction.

5. The purchase price paid by the buyer shall be the amount of the final bid plus a twenty-seven percent (27%) buyer's premium, discounted to twenty-five percent (25%) for cash (US currency only) or check (US Bank check only). For example, if the final bid is $500, the purchase price is $635. All purchases are subject to state and local taxes where applicable, which are computed on the purchase price. If any part of the purchase price is paid by credit card, the buyer's premium shall be calculated at twenty-seven percent (27%) on the entire purchase.

6. Property purchased from the Gallery by a successful bidder may not be removed from the auction sale premises until the full purchase price plus the buyer's premium and all applicable taxes have been paid. The purchaser must pay for and remove all property from the auction premises on the same day as the auction sale.

7. If the purchaser fails to fulfill these conditions, in addition to all legal remedies available to the Gallery, the Gallery may: a) cancel the sale and retain any payments made as liquidated damages; b) resell the property for the account of the buyer, in which case the buyer shall be liable to the Gallery for all its costs and damages, including the commissions for both auctions; c) remove the property to a public warehouse for the account and at the risk and expense of the buyer.

8. All property must be removed the day following the Auction by 1:00 pm. For example, if the auction takes place on Saturday, all property must be removed by 1:00 pm on Sunday. After that time all property will be moved to our Maple Avenue facility, and if the property is not picked up in a timely manner, the Gallery will add a $75.00 handling charge to the purchase price. After sixty days, the Gallery reserves the right to send the property to a public warehouse for the account and at the risk and expense of the purchaser.

9. Items with a low estimate of $5,000 or above have, insofar as they are uniquely identifiable from the description given, been checked against the computerized database of stolen or lost artwork, antiquities and other cultural objects maintained by the Art Loss Registry.

10. FIRST TIME BIDDERS AT STAIR GALLERIES WILL BE RESTRICTED TO A BIDDING LIMIT OF $5,000.

11. All bidders are strongly urged to request a condition report for the object that you are bidding on, if you have not viewed the item in person at our Gallery. Requests for condition reports must be received within 72 hours prior to the auction to allow ample time to fulfill your request.

12. Shipping is the sole responsibility of the buyer, under no circumstances will Stair Galleries pack and or ship items. Upon request, our Client Services Department will provide a list of shippers for you to choose from.

13. It is the bidders sole responsibility to make sure that they are bidding on the correct item, as well as placing the correct bid amount. Stair Galleries will not be held responsible for any bidder errors, including, but not limited to: a bid placed on the wrong lot, or for the wrong amount. There will be no exceptions to this policy.

14. STAIR GALLERIES WILL NOT REVIEW OR APPROVE ANY REQUESTS TO BID AFTER 12 PM ON FRIDAY, FEBRUARY 26, 2016 FOR THE FRIDAY, FEBRUARY 26TH SALE. THERE WILL BE NO EXCEPTIONS.

PACKING/SHIPPING
• It is the bidder's responsibility to take shipping and handlings & insurance costs into consideration when bidding on items.
• BIDDERS PRESENT AND TAKING ITEMS AFTER AUCTION - Since item liability transfers upon a successful bid, items paid for must be packed, transported and/or removed by the purchaser at his/her own risk after the close of the sale. We recommend that you arrange insurance for your items immediately upon becoming the highest bidder. If any employee or agent of DMA shall pack or transport the merchandise, it is fully at the risk and responsibility and expense of the purchaser. DMA shall not be held liable for any loss or damage that may be caused by the said agent or employee.
• ITEMS NOT PICKED UP THE DAY OF THE SALE - Packaging, shipping, and insurance on items will be made available as an added courtesy and cost. We recommend that you arrange insurance for your items immediately upon becoming the highest bidder. Again, if any employee or agent of DMA shall pack or transport the merchandise, it is fully at the risk and responsibility and expense of the purchaser. DMA shall not be held liable for any loss or damage that may be caused by the said agent or employee. All applicable charges will be applied. Shipping will be based on actual costs via FedEx, FedEx Freight, or USPS (best way). Handling and insurance will vary in cost depending on each invoice. All packages will be shipped with insurance. Items will ship seven to fourteen (7-14) business days after payment is received.
• INSURANCE - Shipping insurance is automatically added up to $1,000 for every package. If your package is valued at >$10,000 we will also automatically add "Additional Insurance", which you can decline by contacting us. If you wish to arrange for "Additional Insurance" for packages valued between $1,000 and $10,000 please contact us prior to payment and we can quote this additional insurance amount for you. Insurance for all 3rd party shipments must be arranged through that carrier.
• INTERNATIONAL SHIPMENTS - DMA has the capability to ship to international bidders. By law, DMA cannot, and will not, declare lesser values for any international purchases and all shipments will include the invoice with purchase totals including the buyer's premium and shipping cost. All international bidders are responsible for knowing their country's laws on importing items and for paying all customs and duties on the items.
• 3RD PARTY SHIPPING of Large Items - Bidders MUST arrange and pay for 3rd party shipping when packages are a certain weight, length, or dimensional size.
o Dimensional size is length (the longest measurement) + (height x 2) + (width x 2). For example a 36" x 36" x 12" package = 36 + (36 x2) + (12 x 2) = 132"
o USA home shipments must be <70 lbs. and <108" length and <165" dimensional size
o USA business shipments must be <150 lbs. and <108" length and <165" dimensional size
o International shipments must be <150 lbs. and <108" length and <130" dimensional size
o There may be certain shipments that meet these requirements that will still require 3rd party shipping, and we will communicate the reason in those cases.
• For any buyers who wish to arrange, or must arrange due to the size of the item, for their own shipping, DMA must be notified at least seven (7) days prior of shipping company name and arrival date and time. Pickup must be scheduled to begin and end within our normal business hours (9am - 4pm, seven days a week). Buyers must arrange weekend pickups in advance with DMA staff, and additional charges may be necessary for overtime. 3rd party shipper must arrive with a copy of the invoice
• STORAGE FEE - DMA will charge a storage fee of $50/week for any items awaiting pickup for more than 14 days.
• MORPHY AUCTIONS, LAS VEGAS LOCATION SPECIAL COURTESY - Items purchased at our Las Vegas location may qualify for free shipment on our freight truck to Denver, PA. To be considered for shipping, all item invoices must be paid in full by day 7 after the auction, or they will not be shipped on the truck and shipping charges will then apply. Items will leave Las Vegas approximately 14 days after the auction date. Upon arrival in Denver, PA the buyer must pick items up within 14 days, or a $50/week storage fee will apply. Buyers will be contacted by phone or email when items arrive in Denver, PA. It is the buyer's responsibility to pick the items up here. For packages to qualify for courtesy shipping, at least one piece or all pieces together in a package, must have a dimensional size of more than 130sq inches. Dimensional size is length (the longest measurement) + (height x 2) + (width x 2). For example, a 36" x 36" x 12" package = 36 + (36 x2) + (12 x 2) = 132.
• FIREWORKS - DMA can only ship Class 1 Division 1.4 and 1.6 Explosives (as described in the following website: http://environmentalchemistry.com/yogi/hazmat/placards/class1.html) per the 49CFR 173.50 and can only ship these via FedEx. All items not shippable must be picked up by the buyer.
