Description

Karl L. H. Müller, (Mueller) German/American, (1820 - 1887), "The Stonecutter", White Metal, 10 inches high, Signed on the rear "K. Müller" on the rear of the base and marked "Patent" on the rear of capital. On the inside of the base it is marked "Müller, NY". Müller came to the United States from Germany and worked as on of the head designers for the Union Porcelain Works Company in Brooklyn. His designs were sculptural and iconic. He also did a group of proletariat figurines many of which were cast by his brother Nicholas Müller. The signature on the rear of the figure clearly reads "K. Müller" but the signature on the underside is partially covered by the joinery of the figure to the base so it is unclear whether this signature is for Karl or Nicholas.

Registration
I. When you register to bid in an auction, you will be required to pay a deposit of HK$500,000 with all relevant documents as follow in order to complete the registration.
II. Documents that must be provided when completing the on-line/live bidding registration:
(1) Individuals: photo identity i.e. national identity card and/or passport; proof of current address (if the current address is not shown on the identity document), i.e. utility bill or bank statement.
(2) Corporate clients: a certificate of incorporation and official documents listing directors and shareholders.
(3) Agents and/or Acting Personnel: photo identity of the agent and/or acting personnel, identity document
of the person/company that the agent and/or acting personnel represent, original copy of signed and/or chopped authorization letter from the particular person/ company.
III. Please note that Poly Auction (Hong Kong) Limited does not accept payment from any third party and this also applies to agent. If you participate in the bidding on behalf of others, Poly Auction (Hong Kong) only accepts the payment of the principal.
IV. All deposits must be paid in HK dollars by telegraphic transfer, credit card acceptable to Poly Auction (Hong Kong) Limited and/or Union Pay Card under your name. If you are not successful in any bid, the deposit (without interest) will be returned to you by any method as determined by Poly Auction (Hong Kong) Limited within 14 days after the end of the auction. If you successfully bid for any lot(s), Poly Auction (Hong Kong) Limited can use the deposit to offset any amount of purchase price of the lot(s) that bought by you. Any losses or expenses from foreign currency conversion involved in the refund will be borne by you.
V. Poly Auction (Hong Kong) Limited has the right to demand the Bidder to provide any proof of financial conditions, guarantee, proof of bank deposit and/or any other necessary documents that our company can demand, at its absolute discretion, and/or asking the Bidder to provide any other collateral for the Lot(s) that the latter intends to bid. Our company reserves the right to investigate the sources of funds of the Bidder.
VI. Please be aware that Poly Auction (Hong Kong) Limited can refuse any bidding registration without any explanation at its' sole discretion.
VII. You will not be approved for live bidding unless you complete the registration in full.

Live Auction Fee & Buyer's Premium

The standard buyer's premium is 18% of the hammer price. Any bids sent to us via Invaluable Auction websites attract an additional 3% charge on top, making a total of 21% of the hammer price. The extra 3% covers the service charges made by Invaluable Auctions.

We will send the buyer settlement advice via email /post to successful bidders after the sale.
Payment
Invaluable Auctions will not be responsible to charge any amount owed for lots purchased during the live bidding. Payment must be made directly to Poly Auction (Hong Kong) Limited.

I. In addition to the Hammer Price, the Buyer agrees to pay the applicable commission in respect of such Hammer Price. Payment must be made within 7 calendar days (including the day of Sale) from the day of sale. This applies even if the Buyer wishes to export the lot and export license is (or may be) required.

II. Where Lot(s) is(are) not collected within 30 calendar days (including the day of sale) from the day of sale, the Buyer must pay the monthly storage fee of HK$800 per lot starting from the 31st day. For storage less than one month, one whole month's storage fee will be charged. All other additional expenses such as insurance, packing and/or transportation costs will be charged separately.

III. Our company accepts the following types of payment:

Payment should preferably be made by telegraphic transfer directly to our company's account. Please include your name, client number or lot number with your instructions to the bank.

CREDIT CARD/UNIONPAY CARD

Our company accepts payments by credit cards and/ or Union Pay which is acceptable to Poly Auction (Hong Kong) up to HK$1,000,000 per auction sale. The Buyer has to bear the administrative charge which is not more than 2.5% of the paid amount. If buyer pay by credit card but not in person, client have to fill in the "Credit Card Authorisation Form" and send back by fax (852 23039860)/ email (cs@polyauction.com.hk) or mail to our office address (subject to conditions).

CHEQUE

Our company accepts personal and company cheques, but please be reminded that the purchases will not be released until such cheques have been cleared. Traveler's cheques are not accepted.

CASH / CASHIER ORDER

If payment is made by cash or cashier order, the purchases will be released immediately. However, our company does not accept sums exceeding HK$80,000 (or its equivalent in other currencies) in cash in a single or multiple payments. Our company requests any new clients or purchasers preferring to make a cash payment to provide proof of identity and proof of the permanent address. We reserve the right to seek identification of the source of funds received.

IV. If the payment made in a currency other than Hong Kong Dollars, we shall charge the Buyer for any currency costs incurred. This will include bank charges, commissions for converting the currency. The exchange rate of Hong Kong Dollars and that currency will be the rate quoted by such bank as selected by the company, in Hong Kong on the date of payment.

V. Our company will issue an invoice of sold lot (s) based on the name and address which is (are) on the Bidding Registration Form and the registered name and address should not be changed and/ or amended.

VI. Our company does not accept payment from any third party other than the Buyer. This applies to agent as well. If the agent participates in the auction on behalf of any others, we only accept payment from the principal. Except payment from the Buyer directly, our company reserves the right to reject payments from other sources.

Terms & Conditions - Bidding on any item indicates your acceptance of our terms & conditions listed below and all other terms announced at the time of sale whether bidding in person, through a representative, by phone, internet or other absentee bid.

Payment is due within 24 hours after auctions. We Accept Paypal, Visa, Mastercard, Discover, American Express. Credit Cards may be charged up to four (4) days after sending an Invoice.

Appraisals We may sell items with Appraisals or Certificates of Authenticity. In these cases, buyer is responsible for verifying Value, Authenticity, etc… themselves by their own due diligence. Appraisals should be used for verification of gemstone and/or metal weight, size, and grade only, not actual value, as price varies greatly from retail locations. Items should not be purchased with the expectation to resell for appraisal price or for profit. Certificates of Authenticity are based on opinion. By bidding, you are bidding on THE ITEM ITSELF & not the Appraisal or COA that may accompany it.

Returns: We offer a 30 day Guarantee that all items are as described in our catalog. This offers our buyers the assurance that our company stands behind what we sell. (We may require proof that item(s) are not as described to avoid cases of 'buyers remorse'). If you were bidding on the internet, shipping costs & a 10% return fee ($10 minimum) will not be refunded. This pays the fees & commission that we paid to the internet bidding provider that you bid through. After 30 days, since consignors have been paid in full, our 30 day guarantee is void & refunds are no longer available. By bidding, you accept & agree that after 30 days, all items are sold AS IS & All sales are final. There are no cancellations, returns or refunds allowed.

Cancelling your internet bid: We do not cancel internet bids. If you wish to cancel a bid, you must contact the Invaluable directly to cancel it for you.

Auctioneer - Auctioneer reserves the right to reject any bid. The highest bidder as determined by the auctioneer shall be the purchaser. In the case of a disputed bid, the auctioneer shall have sole discretion in determining the purchaser and may also, at his or her election, withdraw the lot or re-offer the lot for sale. The auctioneer shall have sole discretion to refuse any bid, or refuse to acknowledge any bidder. The Auctioneer's decision to refuse any bid, advance the bidding in any manner, withdraw a lot, determine a successful bidder, continue the bidding, to cancel a sale and reoffer and resell an item in dispute, is conclusive, absolute and final.

Reserves & Relisting- Some of the lots in our sales may be subject to a reserve. The reserve is a confidential minimum price, below which the lot will not be sold agreed upon by the consignor & our company. A representative of our company may execute reserves by bidding for the consignor. We relist items if a winning bidder in a previous auction did not pay, if we have multiple types of the same item or it is listed with a reserve and the reserve was not met.

Breach of Sale - If the buyer fails to pay in full with good cleared funds for either items won OR shipping costs by due date or fails to comply with the Terms and Conditions of the Sale as set forth herein, Bridge City Auctions reserves the right to exercise one or more of the following remedies, in addition to any other remedies available to Bridge City Auctions by law: a) Forfeit items & Hold the defaulting buyer liable for the full purchase amount plus storage & collection fees. b) Forfeit items & Charge a Remarketing/Restocking fee of $75 OR 35% of the total amount due (whichever is greater). c) Resell the property at public auction, or privately under such terms as Bridge City Auctions deems appropriate, and the defaulting purchaser will be liable for the original purchase price plus all costs of Reselling the item(s). In addition, the defaulting buyer will be responsible for any costs incurred by Bridge City Auctions including, but not limited to, handling, storage, commissions, insurance, administration, any and all legal fees, incidental damages and all costs relating to this transaction. d) Forbid the buyer from participating in any future auction.

Item & Property Condition - All items are sold AS IS & neither the auctioneer, employees nor any consignor makes any warranties or representation of any kind or nature with respect to the property and in no event shall they be responsible for the correctness, nor deemed to have made any representation or warranty of description, genuineness, authorship, attribution, provenance, period, culture, source, origin or condition of the item and no statement made at the sale or in the bill of sale or invoice or elsewhere shall be deemed such a warranty of representation or an assumption of liability. In no event will the liability of Bridge City Auctions to any purchaser with respect to any item exceed the purchase price actually paid by such purchaser for such item.

Premium

An 15% Buyers Premium is charged on all items

Taxes

New York State residents and all buyer picking up objects in person are subject to 7.375% NYS Sales Tax except if the buyer has a valid NYS Resale Number. Buyers with a Resale Id must fill out a NYS ST-120 form.
