CONDITIONS OF SALE 2016

The sale is governed by Moroccan legislation and the conditions of sale printed in the catalogue. Purchases must be made in cash and prices are stated in EUROS (EUR).
I. ESTIMATES
Estimates are written next to each lot in the catalogue. Estimates do not include the buyer's premium.
II. BUYER'S PREMIUM
Buyers will pay in addition to the price of the final bid or "hammer price" the following digressive charges:
Up to 48 500 Euros: 19% + VAT i.e 22,8 % all taxes included
From 48 500 to 291 260 Euros : 18% + VAT i.e 21,6 all taxes included
Above 291 261 Euros : 17% + VAT i.e 20,4% all taxes included
III. GUARANTEES
According to law, the indications written in the catalogue are the responsibility of the specialists, subject to the possible amendments announced upon presentation of the item and noted in the record of sale.
A pre-auction viewing is organized and opened to the public free of charge. It allows buyers to have an idea of the dimensions and the condition of the artworks put up for auction. Thus, no claim will be admitted, once the sale is pronounced.
The buyers are aware that some lots, might have been enlarged on the photograph and are consequently not
to scale.
The clients caring for a certificate regarding any of the objects in the catalogue can address a request to the specialists. The certificate is at the applicant expense.
Furthermore, no claim regarding usual restorations, alterations or relining will be possible.
IV. BIDS
The bids follow the order of the lot numbers as they appear in the catalogue. The auctioneer is free to set the increment of each bid and the bidders have to comply with it. The highest and last bidder will be the purchaser. In the event of double bidding approved by the auctioneer, the object will be put back for auction, all the amateurs attending being able to contribute to this second sale.
V. ABSENTEE BIDS AND TELEPHONE BIDS
The person who wishes to leave an absentee bid or a telephone bid can use the form provided at the back of the catalogue. It must reach us at the latest two days prior to the auction with the bank details.
If several bids of the same amount occur, the offer that has been first received by CMOOA wins over the others. Telephone bids are a service graciously provided free of charge to the clients who cannot attend the auction. By no means will CMOOA be held responsible for any carrying out problem of the indicated bids or any problem regarding the telephone link.
VI. PAYMENT AND GUARANTEE
Purchases can be paid cash, at the sale place or at the pay-desk of CMOOA. They will only be released after full payment of the amount due.
In case of payments by cheque or by bank transfer, the release of purchases could be postponed until payment is received on CMOOA accounts.
Payments in Euros are accepted at the rate of change effective at the time of the auction. Upon purchase, the object is under the guarantee of the buyer. The buyer has to organize himself to insure his purchases.
CMOOA refuses any responsibility regarding any injury that could be brought upon the object, and that shall be done from the auction.
VII. STORAGE AND COLLECTION
It is much advised the buyers to collect their purchases as soon as possible to limit the storage charges, of an amount of 10 euros per day, which will be charged to them, over a 15 days delay after the auction.
The storage of the lots is not in any way the responsibility of CMOOA.
All the formalities and the shipping are at the exclusive cost of the buyer.
VIII. PREEMPTION FOR THE MOROCCAN STATE
The Moroccan state features the right of preemption for the artworks sold, according to certan international disposals.
The representative, in the name of the state, has to show the will to substitute itself to the highest bidder and has to confirm the preemption in 7 days.
