TERMS AND CONDITIONS OF SALE

All prospective bidders are advised to inspect each lot they wish to bid on and to satisfy themselves as to the description, authenticity, overall condition of each lot and to bid accordingly. All lots are sold AS IS WHERE IS, with no guarantees. Catalogue descriptions and auctioneers statements are opinion only, with no warranty implied. If the auctioneer verbally guarantees item authenticity and said item is proven to be other based on a recognized experts comprehensive report, the auction house shall provide a full refund. All claims must be submitted within seven days of auction sale date. The Auction House will not incur any cost associated with outside appraisals or opinions. The winning bidder shall be responsible for their purchases, absolutely no refunds due to damage or loss.

The Auction House and or its agents reserve the right to initiate, execute and refuse the bid on any lot. Also, the Auction House at any time, before or during the auction may remove any lot.

All lots are sold to the highest bidder AS IS WHERE IS. Live on floor bidders will take precedence over online and absentee bidders if the amount bid is the same.

Forms of payment accepted are: Visa, Master Card, Wire Transfer.

Michael Spooner & Son Auctions Inc. will communicate with all successful online and absentee bidders within 48 hours after auction to arrange shipping details. All sales are final.
Successful Bidders paying via Visa & Mastercard must provide full billing address, security code on the back of the credit card & phone number for bank authorization.

Bidding at this auction, whether in person, by agent, absentee bid, telephone, internet or other means, constitutes your acknowledgement and acceptance of these Terms & Conditions.

Ontario law applies and jurisdiction and venue over all disputes involving these Terms and Conditions shall be adjudicated in Ottawa, Ontario, Canada.

BUYERS PREMIUM:
All lots sold to bidders onsite will be charged a 15% buyers premium. All lots sold via phone, internet bids and absentee bids are subjected to a premium of 18% of the final bid price and a handling fee. Absentee and Internet bids placed via Auctio Zip will be charged an additional 3% internet fee.


Sales Tax:

All items are subject to HST of 13% unless shipped out of Country.

International bidders: Provided items are shipped directly out of Canada from our auction facilities, no taxes are applicable.

SHIPPING:

Buyer Pays Shipping Cost.
As a convenience to out of town BUYERS, Michael Spooner & Son Auctions Inc. will transport items to a 3rd party shipper of your choice for shipping: UPS, Puralator, Fed EX or Canada Post.

Michael Spooner & Son Auctions Inc. will package your items for a small fee then transport items to a 3rd party shipper. No insurance for damages is available if you choose this option. Insurance for loss only is available.

If you require damage insurance the items must be packaged and shipped by a 3rd party shipper. For example UPS-Fedex.

Buyers may also make arrangements to pick up their items.

Michael Spooner & Son Auctions Inc. WILL NOT BE HELD RESPONSIBLE for loss or damages caused by shipping.
There will be no returns or refunds.

Our handling charge is as follows: Ten dollars handling fee for small lots & a Fifteen dollar handling fee for larger lots.

All Duties, Import Tariffs & Taxes are the responsibility of the Buyer.

All Buyers who purchase furniture must make their own SHIPPING ARRANGEMENTS. Storage & local delivery is available for a fee.

If your item(s) are damaged or lost in shipping, you will need to contact the shipper to file a claim. Michael Spooner & Son Auctions Inc. WILL NOT BE HELD RESPONSIBLE for loss or damages caused by shipping.
There will be no returns or refunds.
