Conditions of Sale

The estimates in the catalogue are based on current market prices and acts only as a guide for the prospective buyer. The estimates are stated in the catalogue in Swedish Kronor (SEK) Please note: Bidding as well as payments is to be made in Swedish Kronor (SEK).

The buyer is the person who made the highest bid. In the event of equal bids, the auctioneer will decide which bid shall be valid.

For buyers each purchase a buyers premium of 20% (includes VAT) will be added to the hammer price for each lot, plus a fixed charge of SEK 40 incl. VAT per lot.

On each purchase a premium Value Added Tax (VAT) @ 25% are included in the buyers premium plus a fixed charge of SEK 40 incl. VAT.

LP FOTO accepts bidding assignments free of charge and bids as favourable as possible on behalf of the client.

All bidding assignments are treated confidentially.

Bidding assignments must be received by LP FOTO no later then the day before the auction day. In the event of equal bids, the first one received will confer the right of purchase. LP FOTO is not liable for any loss that the client may be caused if LP FOTO fails to carry out the bidding assignment.

BIDDING BY TELEPHONE
Clients living outside Stockholm, who whish to bid by telephone should make a request in writing to LP FOTO not later than one day before the auction. Some form of identification and reference will be required. The request should specify which lot (s) to bid for and at what telephone number the client can be reached.

When the bidding is about to start for a specified lot a reprehensive of
LP FOTO will telephone the client who can then bid at the auction through the reprehensive.

This service is conditional upon the availability of telephone lines and staff.

Transfer of purchase afterwards is not allowed.

Items purchased can be paid for and collected appr. 1 (one) hour after the auction ends, at LP FOTO, Regeringsgatan 83, Stockholm. Or not later than 5 working days after the auction.

PAYMENT
Payment can be made in cash or with Swedish bankcard immediately after the auction end. We cannot accept Eurocheques or foreign cheques.

PAYMENT OF WRITTEN BIDS
Purchase made by buyer/absentee or telephone bids must be paid, and
the items collected not later than five working days after the auction at
LP FOTO, Regeringsgatan 83, Stockholm. For lots that are not collected with in five working days after purchase, a storage fee will be charged of SEK 30:- per lot and calendar day. A preliminary pricelist will be published on our website, www.lpfoto.se approximately two days after the auction.

All lots are sold in existing condition. That is therefore very important that the prospective buyer, before the auction very carefully examine every lot he is interested in, to access the condition and quality of the lot.

Any hidden defects must be made subject of a complaint immediately after the purchaser discovered the defect, but no later than 10 working days after the auction.

LP FOTO liability for defects are limited to what is stated in this conditions of sale.

LP FOTO is not liable for information in lists or catalogue being incorrect unless the incorrect information was provided as a result of gross negligence.

LP FOTO is entitled within reasonable time to correct defects in lots sold on auction that LP FOTO is responsible for. Otherwise the purchaser is entitled to cancel the purchase.

In return for returning the lot the purchaser receives the amount he paid to LP FOTO in connection with the purchase. The purchaser is not entitled to any further compensation.

All transportation of goods from or to LP FOTO are made on the purchasers own cost and risk.

If delayed delivery due to circumstances LP FOTO is responsible for lasts more then 20 working days, the purchaser is entitled to cancel the purchase and receive the amount paid to LP FOTO in connection with the purchase.

The purchaser is not entitled to any further compensation.

The items are classified with care by LP FOTO as a guide for the purchaser:

AA: New in unopened box.
A: Like new.
B: Very good condition (only small signs of use).
C: Normal condition (usual signs of use).
D: Outward surface very worn.
E: Very bad condition.
To be more specific we also use two letters e.g. B-A = very good condition near like new. In this case the emphasis is on the first letter. LP FOTO is not liable under any circumstances for any natural wear and tear, minor damages and defects due to normal usage or not usage or natural changes in natural materials or lenses.

All bidding assignments and bids during the auction are valid for the bidder. LP FOTO is entitled to exclude some buyers from the auction without any explanation.

LP FOTO is entitled, under special circumstances, to exclude items from the auction. Any change of this nature will be announced only in connection with the auction.

Force majeure
LP FOTO is exempt from sanction for failure to meet a certain obligation in accordance with this agreement if the failure is based on a circumstance of the type stated below and the circumstance prevents or considerably hinders the obligation being met promptly. Circumstances providing grounds for exemption include acts of war, fire, accident, labour conflict, measures taken by authority, currency restrictions or equivalent circumstances.

Disputes concerning purchase or these terms shall be settled in accordance with Swedish law at court in Sweden.

Contract

Your bid is your contract. Please do not bid on an item if you do not have any intention in purchasing it.

Payment
