Payment Terms: Please take note that your credit card may be charged 4 days after the auction. All major credit cards accepted, Pay Pal also . Please note that we will not accept Credit/Debit Card payments for any transaction for an Invoice that exceeds EUR 3,000.00, such transactions are only accepted by Bank Wire Transfers.
Buyer's Premium: A Buyer's premium amounting to 15% of the winning bid amount will be added to the purchase price of each lot plus 5% Invaluable.com/Auctionzip.com fee. The winning bidders acknowledge and agree to pay a total of 20% premium on top of the winning bid price.
**Note to bidders: Please be advised of the following:
** All Diamonds and colored stones have been submitted to valuation by an independent jeweller while being set in mountings and the specification of the stones is a professionals opinion unless the diamonds or colored stones have a certificate.
** Each piece of jewelry will be submitted to Assay office of Latvia for certification and additional valuation after been fully paid for by the highest bidder and before being shipped.
**An estimate price range will be given to our clients for reference. These estimates are only for educational purposes. Bidding normally begins at about one half of the low estimate.
Remedies
On the fall of the Auctioneer's hammer, or upon the statement of "sold," the highest bidder or authorized agent shall be deemed to have purchased the offered lot, in accordance with all of the conditions set forth herein and will pay the purchase price in full plus buyers premium, any applicable taxes, shipping & handling fees (if applicable). If the foregoing conditions or any other applicable conditions herein are not complied with, in addition to other remedies available to us and the Consignor by law, including but without limitation to the right to hold the Purchaser liable for the purchase price, we, at our option, may either:
i. Cancel the sale
ii. Resell the property and notify the Purchaser within 3 days
**Failure to complete the purchase in accordance with the terms provided herein and in the listing will cause the Bidder to be faced with all, or any combination of the following measures: elimination of all future bidding privileges on the hosting site; credit agency reporting; legal and/or collection action.
Fine Jewelry and Watches: Precious gems and metals will be tested and are guaranteed genuine as described. Gemstone quality will be described if not normal. Weights and measurements are approximate. Obvious and objectionable repairs or alterations are noted. Watches are the original factory product unless otherwise indicated. Original dials and overall watch condition will be noted on important pieces. Watch functions and accurate timekeeping are not guaranteed. The condition, age, originality, and quality of all items are evaluated using industry standards, and any questions should be asked prior to the sale. Jewelry and watches are sold as collector's items. Therefore, everyday use should be evaluated on an item-by-item basis.
PRAGMA LLC guarantees the authenticity of that portion of the description of each lot as set out in bold type in the catalog, as amended by oral or written salesroom notes or announcements, which guarantee is in effect for 30 days after the auction in which the item is sold. Said guarantee does not apply to those lots listed as "in the style of," "attributed to," "the school of," "in the manner of," or "after." PRAGMA LLC is not responsible for errors or omissions in the catalog or in written or oral condition reports. All measurements are approximate. PRAGMA LLC makes every effort to accurately describe its merchandise, but in the event errors occur, PRAGMA LLC shall not be held responsible. It is solely the responsibility of the bidder to be well informed before bidding. Bidding in our auctions indicates your acceptance of these terms and any terms announced the day of the sale.
Returns Policy
Returning items from outside EU Europe
The buyer/winning bidder has to inform PRAGMA LLC
We hope your goods reaches you in perfect condition, however if the items are damaged in transit, or are faulty please contact us on same day of receiving the item so we can advise you what to do. Please retain the original packaging as you may be asked to return this with the jewelry & watches to us.
Please pack returned goods with care and send them by a trusted logistics company or an which provides adequate insurance to cover the value of the item and requires a signature on receipt. It is imperative that you use the correct logistics service when returning goods to us, as we cannot be held responsible for any items returned to us that are lost in transit.
You may return items in a new and unused state, in perfect condition, with all tags and stickers attached to them. PRAGMA LLC will not accept any return if any item that was purchased new shows signs of wear, has been used, or has been altered from its original condition in any way.
You may return the item won on a PRAGMA LLC held auction only if a certified professional has issued a proof that the item does in any way match the description provided by PRGMA LLC (unless there is a certificate or other paperwork that confirms the information stated in description of an item) within 3-5 days following delivery, for exchange or for refund to your credit card or PayPal account.
If returning items from overseas outside the EU Europe please clearly write on your customs declaration 'RETURNED GOODS/FAILED SALE'. If it is not clear that your jewelry is a return and we incur customs charges we will pass these on to you.
Also please write the item description as 'Fashion Accessory' as not to raise awareness to the contents enclosed.
Shipping Terms
PRAGMA LLC provides handling, packing and shipping services solely as a convenience for our bidders. International shipments are EUR100 - EUR350. Shipping cost is included in the bidders post sale invoice. In the unusual event of a shipment exceeding seven business days we will notify recipient of delay and offer an estimate for delivery. All shipments are insured at the total bid amount contained in the shipment (other add-on charges are not covered by insurance). We pay for insurance services at our own expense as a security for both our bidders and PRAGMA LLC. We also require a Direct Signature from the Bidder once the merchandise is received.
We ship within 5-7 business days after receiving payment, every shipment will be packed professionally and we ship worldwide. Tracking numbers are also emailed as soon as packages get shipped. The items are shipped using DHL services and each package is fully insured.
Payment Details
All payments shall be made in full within 3 days after receiving the bidders post sale invoice.
Any payments not made within 10 days after its due date shall be considered delinquent and shall constitute a default on the part of buyer with respect to its obligations under these PRAGMA LLC. In such event, PRAGMA LLC shall be entitled at its absolute discretion to exercise one or more of the following rights or remedies (in addition to asserting any other rights or remedies available to it by law): (i) to charge interest at such rate as PRAGMA LLC shall reasonably decide; (ii) to hold the defaulting buyer liable for the total amount due and to commence legal proceedings for its recovery together with interest, legal fees, and costs to the fullest extent permitted under applicable law; (iii) to cancel the sale; (iv) to resell the property publicly or privately on such terms as PRAGMA LLC shall deem fit; (v) to set off the outstanding amount remaining unpaid by the buyer against any amounts that PRAGMA LLC may owe the buyer in any other transactions; (vi) to reject at any future auction any bids made by or on behalf of the buyer or to require a deposit from the buyer before accepting any bids; and (vii) to take such other action as PRAGMA LLC deems necessary or appropriate.
