"For me the painting is a simulacrum. It is not a simple object that one hangs on the wall to decorate. It is an instrument, the place of an exorcising operation: according to its own rules it simulates an obsessive fantasy because invisible and incommunicable. Hence the theatrical character of my compositions; I regulate a sort of pantomime of my fantastical motifs. "Pierre Klossowski, interview with France Huser du Nouvel Observateur in 1982.

These technical platforms make it possible to participate remotely by electronic means in online public auctions. Thereupon, the participant via one of these platforms must read and accept without reservation, the conditions of use, which are independent and in addition to these general conditions of sale of the Hôtel des Vente de Lausanne.
The fact of participating in auctions: in the room, electronically, by telephone or by order of purchase, implies that all buyers or their agents accept and adhere unconditionally to all these conditions of sale. They are deemed to act in their name and on their behalf:

Art. 1 - The auction takes place strictly in cash and without guarantee, its conduct and adjudication is in euros or Swiss francs and other currencies instantaneously, on the exchange table visible in the room and on the Internet. Before the start of the auction, a brochure with a personal bidder number is given to each person present in the room who wishes. It allows you to bid and be recognized. This number also makes it possible to automatically and immediately establish the slip (invoice) payable at the end of each shift. The auctioneer reserves the right to refuse bids from people who do not have this brochure.

Art. 2 - The minimum bid amount is set at 10%. However, the auctioneer may modify this rate by announcing it beforehand.

Art. 3 - The Auction House is legally bound to respect the reserve prices recorded in the reports of its estate inventories and in the other causes of requisitions for auctions. The auctioneer is therefore required to bid on behalf of the sellers, and when this price is not reached, he moves on to the next lot with a simple blow of the hammer.

Art. 4 - The auctioneer has the right to change the order of the lots and to separate, combine or withdraw lots, at his absolute discretion.

Art. 5 - The auctioneer has the right to refuse an auction and / or the adjudication of a lot. Anyone who deliberately obstructs or distorts the auction will be liable to police penalties.

Art. 6 - The indications mentioned in the catalog engage the responsibility of the Auction house and its experts, subject to the corrections announced at the time of presentation of the lot and recorded in the minutes of the sale. The members of the study, the experts and the auctioneers are at your disposal to inform you about the lots, their time, and their condition. Estimates, dimensions, colors of reproductions and information on the condition of the lot are provided for information only. All information relating to an incident, accident, restoration or precautionary measure affecting a lot are communicated in order to facilitate its inspection by the potential buyer and remain subject to the sole discretion of the latter. This means that all the lots are sold in the state in which they are at the precise moment of their adjudication and no complaint of any kind whatsoever will be accepted, even if it relates to an incorrect description appearing in the catalog. . The condition of the frames is not guaranteed, the usual restorations and relining are considered as protective measures not leading to depreciation. Status reports can be communicated on request, for information only and free of charge on request, by e-mail or telephone.

Art. 7 - The adjudication will be pronounced in favor of the last bidder after the word "adjudée" has been pronounced. In the event of a dispute, the auction is canceled and the lot will be immediately put back on sale.

Art. 8 - The highest bidder and last bidder of a lot will be the winner. In the event of a double bid, leading to a dispute between two bidders in the room and / or on the phone and / or live by Internet, a dispute recognized as real by the auctioneer, the lot will be immediately put back up for auction.

Art. 9 - Payment for purchases can be made by bank transfer or unlimited cash in accordance with the Federal Law on Monetary Unit and Means of Payment (LUMMP). The Auction House is free to accept or refuse payment by certain credit cards. The Postcard direct debit card is accepted free of charge. The Maestro direct debit card will be subject to a 0.50% surcharge. Credit cards, Visa and Mastercard with a surcharge corresponding to 2.3% of the total amount debited as part of the fees collected by the card issuer.
American Express and other credit cards are not accepted.
Cheques are not accepted.

Art. 10 - The buyer pays a 23% due in addition to the auction price of each lot, plus 7.7% VAT on this due. These sales charges are increased by 1.5% for purchases by Drouot Live and by 3% by Invaluable.

Art. 11 - For an amount of VAT greater than CHF 50, any foreign buyer exporting his lot can request a refund of VAT upon sending the export documents validated by Swiss customs. For batches temporarily admitted, they will be imported definitively if the buyer is resident in Switzerland or they will be shipped from the seller's country to the buyer's country with application of Swiss legislation on VAT exemption.

Art. 12 - The buyer does not become the owner of the lot until the time of full payment.

Art. 13 - The purchased lots must be removed and packaged at the risk of the buyer.

Art. 14 - At the request of buyers, the Auction House may recommend service providers capable of handling, packaging, storage and transport. This recommendation will not be the responsibility of the Auction House. It is the buyer's responsibility to insure the lots as soon as they are awarded, since from this deadline, the risks of theft, loss, damage or others are their sole responsibility. The Auction House declines all responsibility for the damage itself or for the failure of the successful bidder to cover his risks against such damage.

Art. 15 - Any dispute relating to this sale is subject to the exclusive application of Swiss law and to the jurisdiction of the courts of the canton of Vaud, regardless of the place of the auction and the domicile of the parties.
