1. The highest accepted bidder shall be the purchaser. Any bidder acting for any person who is not bidding shall be jointly and severally liable with that person for satisfaction of all obligations and liabilities hereunder.

2. Should any dispute arise between 2 or more bidders, or between the auctioneers and any bidder, the Lot or Lots in dispute shall be put up again or not at the discretion of the Auctioneers and their decision shall be final.

3. The purchaser shall give his name and place of abode at the fall of the hammer. Purchasers paying by cheque must be prepared, if required, to produce a letter of credit from their bankers.

4. The ownership of the Lot purchased shall not pass to the buyer until he has made payment in full to Crow's Auction Gallery Ltd of the 'total amount due'.

5. The Auctioneers reserve the right to sell in such order and manner as they shall decide and to withdraw any Lot at any time.

6. No Lot or Lots shall be removed from the Auctioneer's premises until paid for and a receipt obtained. Each Lot shall immediately at the fall of the hammer be considered as delivered and remain in every respect at the absolute risk of the Purchaser thereof and shall be removed at the Purchaser's expense not later than 3.00pm on the day following the Sale. Neither shall any undertaking of the Auctioneers or their servants to take charge of any Lots after the Sale or to forward them to their destination be held to impose upon the Auctioneers any legal or equitable liability or obligation. The buyer shall be responsible for any removal and storage of any Lot not taken away within 24 hours after the day of the Auction.

7. No Lot may be removed during the time of the Sale. No person to be entitled to anything not described in his Lots. No allowance whatsoever will be made for errors in description, authenticity or quantity. Purchasers must satisfy themselves as to the condition of a Lot.

8. Mechanical and electrical Lots - No warranty or guarantee is given that these are in working order.

9. Every person whilst on the premises before, during and after the Sale shall be deemed to be there at his or her own risk and with notice of the conditions of the premises or the method of arranging the furniture and no person shall have or make any claim against the seller or the Auctioneer in respect of any accident which may happen.

10. If any purchaser shall neglect or fail to comply with the above conditions the Lot or Lots shall be resold or otherwise disposed of in any way whether or not notice be given to the defaulting purchaser at the discretion of the Auctioneers and the deficiency if any incurred shall be made good by the defaulting purchaser at this present Sale and be recoverable from him as liquidated damages.

11. The Auctioneers to be the sole arbitrators in every matter of dispute and their decision shall be final.

12. VAT - If the Vendor is registered for VAT the Lots entered will be sold as VAT inclusive. A Vendor is not deemed to be registered for VAT unless he advised us of his VAT Registration Number.

13. THERE IS A BUYERS PREMIUM OF 20% + VAT which shall be payable in addition to the bid price.

14. Please note that that any lots purchased via internet live auction service will be subject to an additional 3% commission charge + VAT at the rate imposed on the hammer price

15. Although information has been obtained from sources deemed reliable, the auctioneers make no warranty or guarantee express or implied, as to the accuracy of the information herein contained. Rules

1. Sales are made to the highest bidder and cash-settled.

2. Once the purchaser awards the object, he is obliged to put a down payment and complete the payment the following day. The purchaser must collect the works at his expense and risk within 24 hours after the payment; in the absence, the objects will be stored for 15 days. All the charges, including the insurance, the transport, the storage, and the packaging will be covered by the purchaser. Once the 15 days have elapsed, the Sant'Agostino auction house accepts no responsibility whatsoever with regard to the storage, the conservation status of the works which have not been picked up within the specified deadline.

3. To the hammer price should be added the following auction charges:

- I tax bracket from € 0,00 to € 50.000 27%
- II tax bracket from € 50.001 to € 200.000 20%
- III tax bracket from € 200.001 to € 350.000 17%
- IV tax bracket from € 350.001 to € 500.000 15%
- V tax bracket from € 500.001 5%


4. The auction is preceded by an exhibition so as to assess the conservation status of the works as well as possible errors on the catalogue. As a consequence, after the awarding no objections are allowed.

5. The auction house grants the authenticity of our works.

6. If any complaints arise about the awarding of the lots, the auctioneer has the right to resume the auction from the last bid.

7. In order to attend the auction, it is mandatory to be registered and pick up his own number on presentation of a valid identity card and after filling in the registration form. The number must be returned once the auction ends (after signing the awarding report). The purchasers can not collect the objects until the payment goes through, unless a line of credit was previously opened.

8. No cash is allowed when the transaction value, even if paid in instalments, is equal to or exceeds 1.000,00 €.
We accept:

- non-negotiable cashier's cheque made out to Sant'Agostino Casa d'Aste S.r.l., Corso Tassoni 56, 10144 Torino;
- deposit to postal current account 60169521 made out to Sant'Agostino Casa d'Aste S.r.l.;

9. Any possbile objection must be done within a week from the sale: after a week, the Sant'Agostino auction house bears no responsibility. If the objection is accepted, the entire sum will be reimbursed, except for the auction charges.

10. In the event of default, the client is obliged to pay a penalty equivalent to 20% of the awarding price. If the client put a deposit down, the Sant'Agostino auction house reserves the right to withdraw from the sale and keep the amount or to cancel the contract and keep the amount.

11. The Sant'Agostino auction house reserves the right to reject the bid. The highest bidder, acknowledged byy the auctioneer, will be the purchaser. If any dispute among the bidders should arise or if the validity of the bid should be put into question, the auctionner will determine either which bidder would be awarded or to put the object again up for sale. If any dispute after the sale should arise, our sales records will dispel any doubts.

12. For the objects subjected to State notification, in accordance with art. 2, 3 and 5 of the Legislative Decree 1 January 1939 n. 1089, the purchasers must comply with the existing rules. The purchasers must pay 10% of the awarding price as a deposit and complete the payment upon the expiration of the first refusal. If the first refusal is exercised, the Sant'Agostino auction house will return the entire sum.

13. The sales director can accept written tender bids only if the form included in the catalogue has been filled in and if the bid is equivalent to or exceeds the auction base. The requests for participation through the phone start from lots having an auction base exceeding 500,00 € and must be accompanied by a written tender bid.

14. During the auction, the auctioneer can vary the order of the catalogue and has the right to withdraw, aggregate or split the lots.

15. If you attend the auction, you consequently accept these exisitng rules. The Sant'Agostino auction house acts as a customer's authorized representative, and is obliged to comply with the reserve price of the objects.

16. In accordance with the Legislative Decree 118/2006, if the price of a work exceeds 3.000,00 €, the Sant'Agostino auction house is obliged to pay the resale right on behalf of the vendors to the SIAE. Such fee is included in the commission paid by the vendor for the lots sold and is thus determined:

- 4% for a sale price between 3.000,00 € and 50.000,00 €
- 3% for a sale price between 50.000,01 € and 200.000,00 €
- 1% for a sale price between 200.000,01 € and 350.000,00 €
- 0,5% for a sale price between 350.000,01 € and 500.000,00 €
- 0,25 % for a sale price exceeding 500.000,00 €

17. If complaints arise, the Foro di Torino is exclusivley responsible.
