Description

Almost forming letters, almost forming faces. Ken Turner is a philosopher as much as a painter. His early years spent in India shine through his commitment to his audience. Exhibited in Tate Britain and one of the most important and first UK performance artists in the 1960s, his watercolours and pastels from the 1980s and 1990s have an internal elegance worthy of his soubriquet 'Cornwall's Picasso'. Conditions of Sale

1. Introduction:
These terms and conditions (the "Terms and Conditions") apply to the sale of a Lost Meadow Gallery auction item (the "Artwork") by the Artist (the "Artist") by the Lost Meadow Gallery to you.
2. Title and Risk:
If you are the winning bidder, once the purchase price is paid within 14 days in full, you will become the legal owner of the Artwork. Shipping or collection and insurance will be arranged with you and carry an additional cost (see "Shipping")
3. Ownership of the Artwork Copyright:
3.1 Copyright in the Artwork remains the property of the Artist.
3.3 You may not produce any image of the Artwork and may not, at any time, publish or submit for publication or reproduction any image of the Artwork to any third party, including any internet website for any purpose without the artist's permission.
3.4 If you breach any of your obligations under paragraph 3.3 you agree that: (a) the payment of damages will not be a sufficient remedy to compensate the Artist for your breach; (b) the Artist may, apply to the court for an order to prevent you from continuing to breach your obligations under these Terms and Conditions; and (c) the Artist may, contact the operator of any internet website on which the Artwork is being offered for sale or on which an image of the Artwork has been placed by you or at your direction, and instruct such operator, on your behalf, to remove any such offer for sale or image from any such internet website.
3.5 Selling on during the lifetime of the artist and for 70 years after their deaths carries a secondary payment to the Artist of their beneficiaries.
4. Condition
All artwork is sold as received from the Artist. If any repair has been done these are carried out by the Artist and signed and dated on the artwork and noted in the auction. Lost Meadow Gallery is not responsible for the correctness of any statement of any kind concerning any lot, whether written or oral, nor for any other errors or omissions in description or for any faults or defects in any lot. Neither the seller, ourselves, our officers, employees or agents, give any representation, warranty or guarantee or assume any liability of any kind in respect of any lot with regard to merchantability, fitness for a particular purpose, description, size, quality condition, attribution, authenticity, rarity, importance, medium, provenance, exhibition history, literature or historical relevance. Except as required by British and European law any warranty of any kind whatsoever is excluded by this paragraph.
5. Data Protection:
We may collect, hold, control, use and transmit personally identifiable information obtained from you in the course of your purchase of the Artwork. By agreeing to these Terms and Conditions you agree to such information being used in these ways and for such information to be disclosed to the Artist if you are in breach of your obligations under these terms and conditions.
6. Liability of the Lost Meadow Gallery:
We make no representation or warranty of any kind whatsoever, express or implied, in connection with the Artwork. Lost Meadow Gallery and its officers, directors, employees, shareholders or agents exclude all liability (whether in contact, tort or otherwise), to the fullest extent permitted by applicable law, for any loss or damage that may result to you or a third party in connection with the Artwork.
7. Rights of Third Parties:
No person other than you and Lost Meadow gallery have any rights under these Terms and Conditions other than in respect of paragraph 3 above which confers a benefit on the Artist and is intended to be enforceable by the Artist.
8. Governing Law and Jurisdiction:
These Terms and Conditions shall be governed by and construed in accordance with English law. Disputes arising in connection with this legal notice shall be subject to the exclusive jurisdiction of the English courts.
