SOUTH JERSEY AUCTION TERMS AND CONDITIONS
NOTE: ALL ITEMS WON ONLINE THROUGH AUCTION ZIP LIVE! BIDDING WILL NOT BE AVAILABLE FOR PICK UP UNTIL MONDAY AFTER THE AUCTION. (NO PICK UP OF THESE ITEMS ON SALE DAY AS OUR INVOICES ARE NOT CREATED UNTIL SALE COMPLETION)
Valid Credit Card is necessary to register and will be used for payment.
All property is sold as-is, where is and all sales are final. All property is described to the best of our knowledge; however, neither we nor our consignor(s) make any warranty, expressed or implied, with respect to such property as to the physical condition, quality, rarity, importance, authorship, provenance, medium, period, origin or estimated value of any sold lot. No statement anywhere, whether oral or written, whether made in the catalog or advertisement, bill of sale, gallery posting, announcement or remarks by staff or the Auctioneer, shall be a warranty, representation or assumption of liability. It is important to understand that South Jersey Auction has never, and would never, knowingly offer a fake or altered item for sale, we offer no guarantee of authenticity of any item offered. All measurements and weights are approximate.
Inspection and Auction Facility Location: All Merchandise will be available for inspection at Auction facility located South Jersey Auction, 26 Repaupo Station Road, Logan Township, NJ 08085 on Saturday, June 29, from 8:30 am to 5:00 pm (EST). Doors open for Auction on Sunday, June 30, 8:00 am (EST). Auction starts at 8:30 am (EST). The Online Catalog LIVE Session to start at 12:00 pm (EST).
Questions regarding individual lots by on-line bidders must be submitted by Friday, June 28, 5:00 pm (EST).
Non Present Purchasers: Reasonable efforts will be made to carry out absentee, telephone and online bids of purchasers who are not present at the auction as a convenience of prospective purchasers; however, there will be no liability for any failure or error in the placement of such bids.
The Auctioneer has the absolute and sole discretion to refuse any bid and to advance the bidding in any manner. The Auctioneer also has the right to withdraw any lot, and in the case of error and dispute (whether during or after the sale) to determine the successful bidder, to continue the bidding, to cancel the sale or to reoffer and resell the property. The highest bidder acknowledged by the Auctioneer will be the purchaser. In the case of a tie bid, the winning bidder will be determined at the sole discretion of the Auctioneer. In the event of a dispute between bidders, the Auctioneer has final discretion to determine the successful bidder or to reoffer the lot in dispute. If any dispute arises after the sale, the sale record of the Auctioneer is conclusive. Participation in the Auction may be disallowed for any reason.
A bid is an offer to purchase and by making a successful bid, a bidder is accepting personal liability to pay the purchase price, plus the buyer's premium, all applicable taxes and all other applicable charges. The highest bidder acknowledged by the Auctioneer is the buyer. The Auctioneer is the sole determinant as to who is the successful bidder. Once the Auctioneer's gavel falls, the successful bidder immediately assumes full risk and responsibility for the purchased lot.
Bidding Increments: The Auctioneer will commence the bidding at any level and in increments considered appropriate. Bids will be sought in increments selected by the Auctioneer who will have the absolute discretion to select any increments for any lot and the discretion to vary the increments in the course of the bidding for any lot.
Buyers Premium: There is a 20% Buyers Premium applied to each lot sold. (17% House Premium and 3% Internet Bidding Fee.) I.e., total purchase price will be: hammer price, buyer's premium and applicable taxes.
Sales Tax: Buyers are required to pay state sales tax of 7% unless exempted by law. If exempt, Buyers must file a tax exemption form with South Jersey Auction prior to Auction before any exemption can be made.
Payment: Invoices will be emailed to the successful bidder within three (3) business days of the Auction. Due to the uncontrollable nature of the delivery of email, non-receipt of an 'Email Invoice' does not preclude you from your responsibilities for payment if you were a winning bidder. If you have participated in the Auction, you are encouraged to inquire regarding whether or not you were the winning bidder. Payment must be received/arranged within three (3) business days from auction date. Credit Card will be charged for winning purchase(s) thereafter. South Jersey Auction accepts VISA, MasterCard, Discover, American Express, Cashier's Check, Certified Check, Money Order and Wire Transfer (at buyers expense) as payment for items purchased. No items will be released until full payment has been received and validated. You are responsible for paying in US DOLLAR currency. (We will charge you for any differences and any conversion fees if not paid in US DOLLARS).
Shipping: Buyer pays and is responsible for all related shipping cost, insurance and arrangements. Buyer may request Auction House assistance. All items must be removed from the premises within seven (7) business days of the sale. After ten business (10) days, items remaining in South Jersey Auction's possession will be assessed a storage fee of $5 per day.
South Jersey Auction reserves the right to move forward with any and all remedies available to us, including reporting your bad debt to the live Auction provider and/or any other related entities. Merchandise becomes the full responsibility of the Buyer at the close of the Auction, and the Buyer assumes all risk of loss and damage to property. By requesting to participate in any Auction, you acknowledge that you are legally bound by South Jersey Auction's terms and conditions herein. Please note that all emails received on a non-auction weekend will be answered on Monday morning.
