Note: The artist has described the use of the aerial view within his works, stating that "the image, content and perspective are derived from a matrix or series of levels of understanding. We experience this aerial view as a sum of those understandings brought together to make the matrix. On one level, we experience something in this view of our early childhood, playing with lead soldiers in a sandbox. On this level of understanding, we experience the relationship of children to their toys, the sense of manipulation and control, and how we come to experience our world through interaction. The next level extends naturally out of this by viewing the aerial battle in terms of God and man, the relationship of man to deity. From this perspective we ask questions related to destiny, fate, life and death and thus theology and philosophy now enter into the image. Viewing my works on the third level as one of the dead leaving the field of battle we examine existentialism, the metaphysical, life beyond death and the esoteric. The fourth level views the work as a time traveler. In looking back in time we enter the realm of quantum leaps and special equations of time travel and ultimately the questioning of our own existence - its shape and reality. The fifth level deals with the perspective of the cannonball at the apex of its arc. It hovers briefly for just a split second before its earthbound descent. I leave it to you to explore the implications of the fifth meaning." "Oh To Be A Bird On High..." was painted by the artist during 1991 and 1992 in France. Following its completion, the painting was included in a touring exhibition of the country, with stops in Caen, Rouen, Dieppe, Honfleur, Amiens and Paris. The painting has also been exhibited throughout southern Ontario, including the Art Gallery of Hamilton; Hamilton Artist Inc.; Jackson Square, Hamilton; City Centre Plaza, Hamilton; and the Central Public Library in London.

By bidding at auction, bidders are bound by those Conditions and Glossary, as amended by any oral announcement or posted notices, which together form the contract of sale between the successful bidder (buyer), Waddington's™ or Joyner™, and the consignor (seller) of the lot.

Descriptions or photographs of lots are not warranties and each lot is sold "as is" in accordance with the Conditions of Sale.

Payment

Payment for purchases must be by cash, INTERAC direct debit (Cdn clients in person only), certified cheque (U.S. & Overseas not applicable), travelers cheque, bank draft, electronic transfer (fee applies), and VISA, Mastercard (up to $25,000). As Waddington's requires written authorization for all credit card purchases, credit cards must be presented in person by the cardholder and therefore cannot be accepted over the telephone. However, fax authorization arrangements can be made.

The buyer shall pay for all lots within 48 hours from the date of the sale, after which a late charge of 2% per month on the total invoice may be incurred or the auctioneer, in his sole discretion, may cancel the sale. The buyer shall not become the owner of the lot until paid for in full. Items must be removed within 10 days from the date of sale , after which storage charges may be incurred.

Each lot purchased, unless the sale is cancelled as above, shall be held by the auctioneer at his premises or at a public warehouse at the sole risk of the buyer until fully paid for and taken away.

Buyers Premium

A premium of 18% of the successful bid price of each lot is paid by the buyer as part of the total purchase price. Artfact Live! clients will be charged a buyer's premium of 21% of the successful bid price of each lot as part of the total purchase price.


Taxes

A charge of 13% HST (Harmonized Sales Tax) is applicable on the hammer price and buyer's premium, except for purchases exported from Canada. In the case where purchases are shipped out of the province of Ontario, the HST or GST is charged based on the tax status of that province.
