General Information:

Kunsthandel Lucian Antoni is a 2017 founded art trade (ATU 71898501) in Vienna (Austria/Europe).
Kunsthandel Lucian Antoni is monogramed in the following paragraphs with
KLA.
Contracts are concluded in accordance with the following Terms and Conditions, unless otherwise agreed.
Conflicting terms and conditions of the contracting parties are not the basis of the contract and are ineffective.
KLA takes responsibility for this descriptions and guarantees that they are
made with the highest level of knowledge and conscience at time of
catalogue creation. However, notice that we are not professional restorers or art historians, nor have access to any scientific research tools or proof.

Estimation, description, price determination:

The estimates shown on are made by our experts. This estimates means
which price the item can possibly reach (expectation) and it must be
understood as a helpful guide for bidding made by the experiences of the
actual market situation. Usually the estimates are made as low as possible
and the worth of an item can be even much higher.
KLA shall be liable to depositors, who are consumers, for damages resulting from an incorrectness of its Price determinations or descriptions exclusively with rough negligence or resolution. In in all other cases, any complaint and any liability towards the depositor shall be excluded.

Products:

Visits are only possible by arrangement with KLM.
Misnomers or faults in our descriptions may happen - the condition of
objects have to be proofed personally. Frames, passepartouts, concealed
damages and other covers of objects and their conditions will not be
described and guaranteed in descriptions, subject to typographical and
printing errors.

Purchase price, payment, transfer of ownership:

The purchase price (highest bid plus fees and all applicable taxes and levies)
is due for payment immediately after the acceptance of the bid.
KLA has even the right in the event of not paying in between two weeks to
cancel the sale and to complaint by justice or any other kind of legal action
at the home address of the hesitate buyer.
Delivery and transfer of ownership of the auctioned objects shall only take place after full payment of the purchase price including all interest, fees, costs and expenses.

Legal lien against the buyer:

KLM shall assert a lien on all items purchased by the buyer at auction.
This lien serves to secure all present and future, including conditional, limited and not yet due claims to which he is entitled from all legal transactions concluded with the buyer. The lien also extends to claims for damages.


Acceptance, transfer of risk, dispatch:


KLA is not responsible for any licenses or documents in case of export or
import or for packing, insurance and transport. Charges for documents have to be paid by the buyer. Even if KLA is assisting in some case, the buyer dispenses KLA for any case of reclamation. The risk of damage or loss is with the buyer after he or his commissioner is receiving the goods, even if the transport was organized by KLA. If transport charges are described as guaranteed in the description the buyer has the guarantee that the transport costs will not be more as stated. KLA advices you to order transport insurance.
KLM accepts no liability for damage occurring during transport.
Auctions must be paid for and taken over immediately. They are stored at the risk of the buyer from the time of acceptance of the bid until their acceptance. The packing and each dispatch takes place exclusive risk and costs of the buyer.
If the buyer or a carrier/forwarding agent commissioned by him fails to collect the items purchased at auction within 14 days of the day on which the contract is awarded, KLM shall be entitled to charge storage costs or to store them with a warehouse keeper at the expense and risk of the buyer.

Indemnity:

KLM cannot be held liable for damages caused by slight negligence and is not liable to entrepreneurs for simple gross negligence. KLM accepts no liability for damage caused by natural events or force majeure, for damage resulting from prolonged storage and for damage resulting from termination in accordance with § 9 Para. 2 or loss of profit. KLM shall be liable for
the buyer of an object for the loss of or damage to the same in the case of gross negligence, towards entrepreneurs, however, only in the case of at least blatant gross negligence.


Return of products:

KLM draws attention to the 14-day right of withdrawal pursuant to § 3 KSchG. Therefore the buyer has the right to withdraw from the contract 14 days after delivery. Should the buyer make use of it, he is obliged to inform KLM and to return the object of purchase to KLM immediately at the buyer's expense. Here too, the buyer bears the risk of damage.
Any returns are excluded.

Applicable law, place of jurisdiction:

All resulting legal disputes are exclusively subject to Austrian substantive law.
The UN Convention on Contracts for the International Sale of Goods (CISG) shall not apply.
The exclusive place of jurisdiction for all disputes arising directly or indirectly from an auction transaction shall be the Austrian court locally and factually competent for 1010 Vienna. This agreement shall only apply to consumers within the meaning of the Austrian Consumer Protection Act if they have neither a domicile nor a habitual residence in Austria and are not employed in Austria and there are no other regulations to the contrary.
