Conditions Of Sale
IMPORTANCE OF TERMS
Please take the time to read the following set of terms and conditions for the auction. By obtaining a Bidder Number, you acknowledge that you have read and agree to these terms and conditions.
BIDDER RESPONSIBILITIES
Bidder is responsible for any and all activity, bids, and purchases involving Bidder's account. Once a bid has been placed, it cannot be lowered or deleted. Bidder agrees to keep its username and password confidential.
CONDITIONS
Lakelands Auction Services has endeavored to accurately describe the items being sold, but all property offered for sale is strictly "as - is" "where - is" with all faults. All sales are final and no refunds are given. The sales records and recordings shall be conclusive. It is the bidder's responsibility to determine the exact condition/authenticity of each item. No statement in this catalogue or by representatives of Lakelands Auction Services shall be considered as a warranty or assumption of liability. Written and oral descriptions given by Lakelands Auction Services staff members are given as a courtesy to a client, are only an opinion, and should not be considered as a guarantee of age, composition, or authenticity. The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear or imperfections. High resolution images are provided to assist a bidder in making an additional assessment of condition. By bidding, you signify that you have either closely examined the items, have chosen not to examine them, or have hired an independent agent to examine the item(s) for you. Condition reports are available via the online catalog or by contacting the Lakelands Auction Services office.
COINS: When offering grade estimates on non graded coins we are merely offering an opinion and cannot be held responsible if your opinion differs. Graded coins will noted as such per the grading company.
Jewelry: All jewelry metal purity has either been tested or is stamped. We test stones using a gem tester and will use our best judgement as to the type of stone being sold. All gemstone weights are best estimates as we have not removed stones and weighed them.
Firearms: All firearms unless noted as New In Box (NIB) should be assumed to be used with normal wear.
BUYER'S PREMIUM
Absentee bidding and live real-time internet bidding is available at lakelandsauction.com with a 12% buyer's premium not including any premium charged by the online bidding provider.
PAYMENT
Firearms Purchases: we will send you an invoice through Square through which you can pay your bill. Please note: we cannot process online bidder credit cards on file for firearms purchases.
Non Firearm Purchases: Following the auction close you will be emailed an invoice including purchase, premium, shipping and all fees. You have 4 days upon receipt of this invoice to open the invoice and pay it. If on the 5th day following receipt of the invoice the invoice has not been paid we will process the card provided at registration. If paying by check, Lakelands Auction Services reserves the right to hold the item(s) until the check has cleared. Federal law requires we report payments above $10,000 made by cash or certain other cash equivalents, such as money orders. International (non-domestic United States) bidders will be required to pay by wire transfer. Wire transfer fees will be incurred by the buyer. At the auctioneer's discretion, certain lots will be required to be paid for by wire transfer. South Carolina sales tax is 7% and is charged to all bidders regardless of state of residence.
AUCTIONEER
Kit Young, SCAL 3812. The auctioneer always reserves the right to withdraw a lot for any reason he deems appropriate, including any lots that may have a reserve, or if there is a lack of bidding interest or lack of appropriate bids. Lakelands Auction Services shall have the right to withdraw any item at any time for any reason and to default any sale in the event of an error or dispute.
REGISTRATION
Bidders may create an account with AuctionZip.com. After signing in to the LelandLittle.com account, complete all necessary steps presented (e.g. agreeing to Terms of Sale) in order to proceed with bidding. All domestic US bids must be secured with a MasterCard, Visa, Amex or Discover Card. International bidders must acknowledge wire transfer payment terms.
BIDDING
Absentee and live real-time internet bidding is available through Auction Zip.com. When Absentee bidding, you may accept the current asking bid or enter a maximum bid value. Lakelands Auction Services cannot be held liable for bids that are not sent or received by the server.
The Online-Only Auction has a soft close; each lot will have a 30 second timer after it opens for live real-time internet bidding. Any lot that receives a bid within the last 25 seconds will have its bidding time extended to 25 seconds. Any and all lots will close either at the designated closing time or at such point that it has not received an advanced bid within a 25 second time frame. Outbid notifications will not be received within five lots of any lot opening for live real-time internet bidding.
LIVE INTERNET BIDS THROUGH THIRD-PARTY WEBSITE(S)
Live internet bidding is available during the auction via third-party website(s). Please be advised that proper time is required to review and respond to registration inquiries received through third-party websites. Additional information may be required to proceed with registration approval, including a wire transfer deposit or auction references. Current bids on the internet will be executed on your behalf during the auction. LLA, Ltd. cannot be held liable for live internet bids on a third-party website that are not sent, received, or executed by the administrator. If you are bidding live, real-time online through a third-party website, please bid quickly because there is a time delay in receiving live bids.
RESTRICTED MATERIALS
Please note that lots containing ivory or any other plant or animal material may be subject to regulations imposed by the Endangered Species Act by the United States Fish and Wildlife Department as well as other restrictions under federal, state and/or local law. Some countries prohibit the importation of property containing materials from endangered plant or animal species and prospective purchasers should familiarize themselves with relevant customs regulations prior to bidding if they intend to import these item(s) into another country. We also suggest that buyers in the United States check with their state's wildlife protection agency for any restrictions on the purchase, possession or sale of ivory or any other animal material. Please note that bidders in New York and New Jersey may not bid on any lots containing elephant ivory, mammoth ivory, or rhinoceros horn. Items containing ivory can only be shipped to an address in the United States. Bidders should check all applicable government wildlife restrictions prior to placing a bid. The buyer will be solely responsible for obtaining any necessary license or permits applicable to the sale or transport of the item(s) including any export or import license and/or certificates as well as any other required documentation.
ESTIMATED WEIGHTS AND MEASUREMENTS
Weights in catalogue description have been estimated through measurement and are to be used as approximate guidelines and not relied on as exact. Jewelry: Unless otherwise stated, all stones have been measured and graded in their settings. Metal weight given for jewelry includes stones unless stated otherwise. Buyers should be reminded that many colored gemstones have historically been treated to enhance their appearance. We test stones using a Presidium Gemstone Tester and base our results on a best estimation of those results. Lab reports will be referenced in catalogue descriptions if available. Silver: Weights provided for flatware services assume dinner knives to weigh ½ troy ounce in sterling silver.
COINS:
Unless listed as professionally graded all grades provided are a "best guess" and Lakelands Auction Services will not be held responsible should the buyer disagree with any grade or condition provided. We attempt to validate the authenticity of each coin being sold. We encourage each buyer to personally inspect each coin prior to bidding as each one is ultimately sold As Is Where Is.
FIREARMS:
All non-black powder firearms manufactured 1898 to the present must ship to a FFL dealer. Copies of your dealer's license can be faxed to 864-374-3063 or emailed to lakelandsauction@yahoo.com. We will include a copy of our FFL with shipment. Any condition estimates provided are a best guess. Lakelands Auction Services will not be held liable for condition disputes. We have not test fired any firearm and cannot attest to its functionality.
CLOCKS AND WATCHES
No warrantee that any clock or watch is in working order is given. Virtually all clocks and watches have been repaired in the course of their lifetime and may include parts not original to them. There is no guarantee to works or movement. Unless otherwise stated, weight includes works.
OWNERSHIP
Item ownership is conveyed immediately following the fall of the Auctioneer's hammer. While we try to handle and store items with great care, Lakelands Auction Services will have no liability for any loss or damage to an item after the hammer has fallen. Lakelands Auction Services is not liable for any damages incurred if assistance with loading is requested. Buyers are welcome to hire a professional shipping or moving company to assist with loading, packing, or shipping.
LOADING
Loading purchased items is the responsibility of the buyer. Lakelands Auction Services will, as a courtesy, assist with the loading following the sale, but this is done at the risk and responsibility of the buyer. Buyers who wish to arrange their own labor may contact the front office to schedule a time during normal business hours. Lakelands Auction Services will have no liability for any damage while providing loading assistance.
STORAGE
Unless prior arrangements are made, pick-up within 10 working days of the auction is required, or a $10.00 per lot per day storage fee will be charged.
ABANDONED PROPERTY
Unless prior arrangements have been made, any lot(s) remaining at the Lakelands Auction Services auction gallery more than 30 calendar days after the auction purchase date will be considered abandoned and no refunds will be given. Lakelands Auction Services is not obligated to notify the winning bidder of the abandoned lot(s).
SHIPPING & PICK UP
Shipment of all items occurs in-house at Lakelands Auction Services. We ship via USPS and UPS only. Items are shipped the safest and least expensive method with tracking and insurance to your registration address with AuctionZip. We do not automatically provide tracking data.
All firearms manufactured 1898 to the present must ship to a FFL dealer. Their FFL can be faxed to 864-374-3063 or emailed to lakelandsauction@yahoo.com. We will include a copy of our FFL with shipment. Signature is required on all firearm shipments.
Coordinating your own Shipping or Pick Up: When arranging shipping or pick up through another vendor or third-party of your choice, we require that you complete our Authorized Release Form. This form authorizes us to release your purchased items to the requested party. We will not release your lot(s) to any shipping vendor or third-party until we have received this form and payment has been made in full. Please note that shipment or pick up is the sole responsibility of the buyer. If you reside in a state or country that has import restrictions or regulations, it is your responsibility to obtain appropriate licenses to ship your purchased items (see the restricted materials section for more detail).
All packing, handling, shipping, and delivery services are performed at the sole risk of the buyer Lakelands Auction Services assumes no legal or financial responsibility and is free from all liability associated with fulfilling your release request.
DISPUTES
Any and all disputes resulting or arising in connection with this auction shall be heard in the General Court of Justice of Greenwood, SC as the sole and exclusive venue.
LEGAL INTERPRETATIONS
This document will be interpreted by the laws of the State of South Carolina and by the United States Code.
