Special Terms of Sale
By submitting your bid, you agree that you have read and agree with the Auctioneer Terms and Conditions below:
1. The successful bidder is the highest bidder acknowledged by the auctioneer. In the event of any dispute between bidders, or in the event of doubt on VDG part as to the accuracy of any bid, the Auctioneer will have the final discretion either to determine the successful bidder or to re-offer and resale the article in dispute.
2. All items are sold AS IS, WHERE IS with all faults. ALL SALES ARE FINAL and we do not allow returns and exchanges. In the rare case of VDG accepting an item for return, VDG needs to have written notice by bidder in form of email to VDGJEWELRY@GMAIL.COM no later than 7 days of receiving the product. It is VDG's sole discretion to approve any return and we generally do not accept returns under any circumstances. VDG will provide a Merchandise Authorization Number. Any allowed returns must be received in the EXACT CONDITION it was shipped to the buyer. There are NO refunds on Shipping & Handling or Buyer's Premium. That means if you ask for a return, you are forfeiting the S&H charges and the Buyer's Premium. Unauthorized returns will be refused. Under no circumstances will any amount other than the winning bid amount less any Shipping & Handling and Buyer's Premium be refunded. Any package refusal by winner bidder constitutes as an unauthorized return and is in direct violation of these general terms and conditions. IF THERE EVER IS A CASE OF A REFUND BEING ISSUED, YOU WILL BE CHARGED A 15% RESTOCKING FEE AND YOU WILL BE RESPONSIBLE TO PAY THE SHIPPING FEES AND BUYER'S PREMIUMS WILL NOT BE REFUNDED. PLEASE BID RESPONSIBLY AND ASK ALL QUESTIONS PRIOR TO PLACING A BID. IF YOU HAVE ANY QUESTIONS OR CONCERNS ABOUT THESE RULES, PLEASE DO NOT BID. 3. Written and oral descriptions are our opinions and should in no way be construed as a guarantee of any kinds as the authenticity, age, condition, materials or any other feature of items being sold. VDG attempts to catalog every lot correctly and will attempt to point out any defects but will not be responsible or liable for the correctness of the catalog or other descriptions of the lot. We recommend prospective bidders examine all items in which they have an interest. By placing a bid, either in person, by phone, absentee or via internet, you signify that you have examined the items as fully as you desire to or that you have chosen not to examine them. No statement (oral or written) in this catalog at the sale or elsewhere shall be deemed such warranty or representation, or any assumption of responsibility.
4. ALL MEASUREMENTS ARE APPROXIMATE.
5. A 18% BUYER'S PREMIUM WILL BE ADDED TO THE HAMMER PRICE ON EACH LOT SOLD AT THE END OF AN AUCTION. THE PREMIUM IS NON-REFUNDABLE. A PREMIUM PAYABLE BY THE PURCHASER OF 15% + 3% Auction House Fee
6. The purchaser assumes full responsibility for items at the fall of the hammer.
7. For all California residents a 8.75% sales tax will be added to your invoice.
8. PAYMENT: We accept all major credit cards, bank transfer, or PayPal.
9. VDG JEWELRY AUCTIONS reserves the right to withdraw any lot at any time before, during, or after the auction without liability. The auctioneer reserves the right to reject any bid at any time and as his sole discretion
10. Important Notices & Disclaimers- PLEASE READ REGARDING APPRAISED JEWELRY AND LOOSE STONES - VDG sends them out to a third party for Retail Replacement Value Appraisals, which are the most common. These types of evaluations are written for insurance needs. This would be the cost to REPLACE the jewelry with an item of equal quality and kind, considered to be the current market price or replacement value. This type of appraisal is done to protect you (the bidder) in the event of damage or loss of a valuable item. Our appraisals are conducted by independent 3rd party appraisal firms that utilize Certified GIA Gemologist. Appraisals should be used for verification of gemstone and/or metal weight, size and grade ONLY, not actual value. Appraisal value should be considered for insurance purposes ONLY, not actual value, as price varies greatly from retail locations throughout the world. Items should not be purchased with the expectation to resell for appraisal rice, or for profit.
11. **VDG has final discretion on sale of an item. Our word is final**
Breach of Agreement
1. In the event of any disagreement between VDG INC., and the customer, all issues shall be governed, adjudicated and filed pursuant to the laws of the State of California.
2. VDG Jewelry is not affiliated with Rolex USA, Rolex International, Cartier Inc. As a watch store able to offer you genuine brand name watches at discounted prices, we are not Authorized Dealers of these manufacturers. We carry mostly pre-owned watches from secondary market in exceptionally excellent condition.
3. We guarantee you that the timepieces we sell are all authentic, unless otherwise stated where there are custom diamond parts such as diamond dial, diamond bezel, and/or diamond band. We do not sell replicas of any kind. Diamonds used in the custom parts of the watches are of top quality stones; with clarity range between VS and SI, and color range between G and H.
4. An Appraisal Certificate is provided for every fine timepiece or jewelry purchased from VDG Jewelry. Valuation may be based between actual purchase amount and its retail list price. In some cases, the item purchased may include also its Original Warranty Certificate (in the case of watches) or Laboratory Certificate (in the case of diamonds).
Payment:
Payment of the winning bid amount, buyer's premium and shipping/handling charges will be made at the time the auction is reconciled and invoiced (email), VDG with its sole discretion will process bidders payment after 24 hours by using the credit card on file with utmost care and confidentiality.
In the event that no credit card is on file, the Bidder will be directed to process payment online under VDG Jewelry Auction Credit card payment system. Please also note that we accept other payment method i.e. PayPal, Wire Transfer, Money Order, Cashier's Check.
Requests for other payment arrangements will only be considered prior to the opening of bidding in any auction. IN ANY CIRCUMSTANCES PAYMENT MUST BE MADE ONLY TO VDG INC.
Shipping Terms:
We provide handling, packing and shipping services solely as a convenience for our Bidders. Because Bidders most often opt for these services, we include an ESTIMATED AMOUNT in the auction invoice.
We ship primarily by USPS courier service priority mail within a commercially reasonable time following credit of the Bidder's payment to our account. On average, a Bidder may expect to receive their items within 3 to 15 business days following their payment upon bank clearance.
The actual cost of shipping will be applied except for promotional offers or special offers where FREE SHIPPING is offered by VDG.
Buyer's Premium:
A Buyer's premium amounting to 15% of the winning bid amount will be added to the purchase price of each lot. The winning bidders acknowledge and agree to pay a total of 15% premium on top of the winning bid.
Sales Tax:
California residents must pay 8.75% sales tax
Condition:
All items are sold on an "As is" basis and all sales are final. It is your responsibility to verify the condition of all items and their details prior to auction either yourself or through an expert if you are unable. We provide no guarantees as to the value of any items or to their condition and will do our absolute best to report any defects or damages. VDG Jewelry Auctions are committed to provide all brand new items in all forms of Gold and Metal Purity including .925 Sterling Silver, in most cases the description of the item(s) will be clearly stated. As a reminder, we hereby encourage our interested bidder and buyer to fully study review the description of the auctioned item(s) prior to bidding to avoid any confusion.
Credit Cards
We may allow you to pay for items you win using an online payment service powered by WePay, Inc. ("WePay"). Your use of the WePay payment service (the "Payment Service") is solely governed by WePay's Terms of Service and Privacy Policy located at www.wepay.com/legal (collectively, the "WePay Terms"). All transactions, using the Payment Service or otherwise, remain subject to the applicable terms and conditions herein (including the refund policies posted therein). You may not use the Payment Service to engage in activities prohibited by the WePay Terms or otherwise to violate applicable law.
If you use the Payment Service, you will be required to provide information regarding your credit card or other payment instrument. You represent and warrant to [Auction House] that such information is true and that you are authorized to use the payment instrument. You will promptly update your account information with any changes (for example, a change in your billing address or credit card expiration date) that may occur. You agree to pay [Auction House] the amount that is specified for the item(s) you are purchasing in accordance with the applicable terms and conditions herein. If after three (3) business days you fail to pay for the items you win in full, the [Auction House] reserves the right to charge your credit card on file the entire amount due (including the hammer price, buyer's premium, all applicable taxes and other charges).
In the event you file a chargeback with your credit card facility to reverse or invalidate a processed payment, [Auction House] and WePay have the right to contest any such chargeback in accordance with the WePay Terms. We and/or WePay may request necessary information from you to contest the chargeback. If the chargeback is contested successfully, your payment will be released to WePay. If a chargeback dispute is resolved in your favor, you will recover the chargeback amount through your credit card facility.
Buyer's Premium
There is an 18% Buyer's Premium plus shipping charges (see shipping section for more details) in addition to the final sales price.
Shipping Instructions
We usually only ship coins and jewelry domestically ourselves, unless otherwise noted on your invoice. We ship USPS Priority Mail or Express Mail, depending on the value of the shipment and First Class Mail for inexpensive items. Winning packages are mailed out within 2-3 business days after we receive cleared payment.All other items must be handled by an outside shipper. IF THERE ARE NO SHIPPING CHARGES ON YOUR INVOICE OR YOU HAVE LARGER ITEMS ALONG WITH COINS AND JEWELRY, YOU MUST CONTACT A THIRD PARTY SHIPPER. Also, unless otherwise agreed upon, we will only ship to the address listed on your PayPal payment or the address associated with your credit card payment. It is your responsibility to change your address with PayPal prior to payment. We will be held harmless for any packages delivered to address listed on PayPal or with buyer's credit card.
Buyer Pays Shipping Cost. Auction house usually ships ONLY coins and jewelry in the US and Canada. All other items require professional packing & shipping. We recommend that YOU contact Ron Kaufenberg at Pack & Send, 239-433-0747 (rkaufenberg@asgc.com), but buyers may contact any shipper of their choice. Items will not be shipped out until payment has cleared. We do combine orders for shipping, if possible. Free local pick-up is also available at auction's location only. International Buyers: You are responsible for any taxes, duties, or surcharges that your country may impose. We will not alter your price or show as gift for customs as this is illegal. We will hold paid items here for a maximum of 10 days, unless other arrangements have been made. If not picked up within that time, we reserve the right to relist the items with the buyer forfeiting all payment. Please ask all questions BEFORE bidding.

Florida Sales Tax
If item is being shipped to a Florida address or is picked up at one of our locations, 6% Florida Sales Tax plus any applicable county tax will be added to your invoice for all items except for US coins or paper money that has a monetary value.
