Weschler's - Terms and Conditions
1. Registration
Prior to sale, all bidders must register online to participate in live bidding. Bidders do not have the right to withdraw a bid once a Weschler's auctioneer accepts it as a winning bid.
2. "As is" condition
The Auctioneer and the Consignor assume no risk, liability or responsibility for the authenticity or the authorship of any property identified in the catalogue (that is, the identity of the creator or the period, culture, source or origin as the case may be, with which the creation of any property is identified herein). All property is sold "As Is" and neither the Auctioneer nor the Consignor makes any warranties or representations of any kind or nature with respect to the property, and in no event shall be responsible for the correctness or any implied warranty or merchant ability or any implied warranty of fitness for a particular purpose as it relates to description, genuineness, attribution, provenance, safety, reliability or condition of the property. If any implied warranties of merchant ability or fitness for a particular purpose can be construed from the catalogue, auction, or bill of sale, such warranties are disclaimed by the Auctioneer and the Consignor. No statement in the catalogue or made at the sale or in the Bill of Sale or invoice or elsewhere shall be deemed such a warranty or representation or an admission of liability.
3. Bidding
Unless otherwise announced by the Auctioneer at the time of sale, all bids are per lot as numbered in the catalogue. The Auctioneer reserves the right to reject a bid from any bidder. The highest bid acknowledged by the Auctioneer shall be the purchaser. In the event of any dispute between bidders, the Auctioneer shall have the sole and final discretion either to determine the successful bidder, or to re-offer and re-sell the article in dispute. If the Auctioneer determines that any opening bid is not commensurate with the value of the article offered, he may reject the bid; and if, having acknowledged an opening bid he decides that any advance is not sufficient, he may reject the advance.
4. Purchaser's Responsibility
On the fall of the Auctioneer's hammer, title to the offered lot passes to the highest bidder who, thereupon will pay the full purchase price therefore or such part as the Auctioneer may require.
After three (3) business days and the failure to pay in full, the Auctioneer reserves the right to charge the Purchaser's credit card on file the entire amount due (including the hammer price, buyer's premium, all applicable taxes and other charges).
All deposits may be applied to any or all purchases made by the purchaser at this or any previous sale. All property shall be removed by the purchaser at his expense on the day of sale and, if not so removed, may be sent by the Auctioneer to a public warehouse for the account, risk and expense of the purchaser. Any damage to or loss of any item purchased which is left with the Auctioneer after the day of purchase is the purchaser's sole responsibility. If the foregoing conditions or any other applicable conditions herein are not complied with, in addition to other remedies available to the Auctioneer and the Consignor by law, including without limitation the right to hold the purchaser liable for the bid price, the Auctioneer at its option, may either (a) cancel the sale, retaining as liquidated damages all payments made by the purchaser, or (b) re-sell the property on 3 days notice to the purchaser and for the account and risk of the purchaser, either publicly or privately, and in such event the purchaser shall be liable for the payment of any deficiency plus all costs, including warehousing, the expenses of both sales, and the Auctioneer's commission at its regular rates and all other charges due hereunder, and incidental charges. No claims shall be allowed after removal of goods and no article shall be re-sold for purchaser at the sale where purchased.
A premium equal to 18* percent of the successful bid price up to and including $50,000, and 12 percent of the successful bid price over $50,000 will be added thereto and is payable by the purchaser as part of the total purchase price.
In addition, online purchasers are charged an additional premium of 5% of the hammer price.
The District of Columbia Sales Tax is computed on this total purchase price. The purchaser will be required to pay the Sales Tax unless exempted through possession of a valid District of Columbia Sales Tax number.
Please Note:
The District of Columbia has no arrangement of reciprocity with any other jurisdiction and the Auctioneer cannot honor a Sales Tax number from any other jurisdiction.
Buyers not known to the Auctioneer and planning to pay with a personal or business check are required to supply the Auctioneer with a bank letter of credit prior to the auction. If such arrangements are not made prior to the auction, purchases will be held by the Auctioneer until the check has cleared the bank.

5. Additional conditions
The Auctioneer reserves the right to cancel the sale or any portion thereof without prior or further notice, and to announce at any time additional conditions of sale.
The Auctioneer will use reasonable efforts to carry out online bids and do not accept liability for equipment failure, inability to access the Internet or software malfunctions related to the execution of online bids.
Credit Card Payment Cont,

Payment
Successful bidders are requested to make total payment for purchases by cash, Visa or MasterCard or pre-approved check on the day of sale.
Buyers not known to Weschler's and planning to pay with a personal or business check are required to supply us a bank letter of credit prior to the auction. If such arrangements are not made prior to the auction, purchases will be held by Weschler's until the check has cleared our bank.
Absentee bidders and Online Internet bidders will be subject to a $1.00 processing fee that will be charged to the bidder's credit card upon registration.
Shipping Information
In order to expedite and properly insure the safe shipment of your recent purchase, please find listed below our recommended shippers. It is the responsibility of each purchaser to make their own shipping arrangements. Please contact one of the recommended shippers or, if you prefer, another shipper of your choice. All the recommended out-of-state shippers listed below are qualified interstate carriers.
Keep in mind, property may not be released without receipt of purchase payment. In addition, once you have finalized shipping arrangements you must notify our shipping department to confirm your intentions. No property will be released without your confirmation with our office.
Purchases shipped out of state via ICC carrier, UPS or USPS are NOT subject to D.C. Sales tax. Unless a valid D.C. sales tax number is given to Weschler's prior to payment, all other purchases are subject to 5.75% D.C. sales tax.

Conditions: Chandler's Auctions and Estate Sales strives to accurately describe the items being sold, but all property offered for sale is strictly "as-is" "where-is" with all faults. All sales are final and no refunds are given. The sales records and recordings shall be conclusive. It is the bidder's responsibility to determine the exact condition and authenticity of each item. No statement in this catalog or by representatives of Chandler's Auctions and Estate Sales shall be considered as a warranty or assumption of liability. Oral and written descriptions given by Chandler's Auctions and Estate Sales staff members in person or electronically are given as a courtesy to a client, are only an opinion, and should not be considered as a guarantee of age, composition, or authenticity. The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear or imperfections. By bidding, you signify that you have either closely examined the items, have chosen not to examine them, or have hired an independent agent to examine the item(s) for you. Condition reports are available via the online catalog or by contacting The Gallery on First.
Auctioneer: Chandler Eshleman, NCAL#9849. The auctioneer reserves the right to withdraw a lot for any reason he deems appropriate, including any lots that may have a reserve, or if there is a lack of bidding interest or lack of appropriate bids. Chandler's Auctions and Estate Sales shall always have the right to withdraw any item at any time for any reason and to default any sale in the event of an error or dispute.
Terms: Sales are subject to the following terms and conditions of sale: Bidding is available by live in-house bidding, live internet bidding, absentee, and telephone. There is an 18% buyer's premium in person, and live internet bidding is available through Invaluabe or Auction Zip online platforms with a 24% buyer's premium. Payment is due at the end of the auction by cash, certified funds, wire transfer, approved check. (Visa and MC for those in attendance only or when paying by phone). North Carolina sales tax is 6.75%.
Online Bids: Live internet bidding is available during the auction. Current bids on the internet will be executed on your behalf during the auction by www.invaluable.com and/or Auction Zip. However, Chandler's Auctions and Estate Sales cannot be held liable for live internet bids that are not sent, received, or executed by the administrator. If you are bidding live, real-time on-line, please bid quickly because there is a time delay in receiving live bids.
Absentee and Telephone Bids: Arrangements for absentee and phone bidding can be made by completing and submitting the Absentee Bid Form by 5:00 P.M. the day prior to sale day. This form is available in the gallery as well as via email by contacting the gallery at info@chandlersauction.com. Phone reservation contact numbers cannot be changed after 5:00 P.M. the day prior to the sale. All bids must be secured with a credit card number (Visa/MC). All absentee bids will be executed in a fair, competitive and confidential manner. While every effort is made to execute and honor absentee and phone bids, C.A.E.S is not responsible for failure to execute a bid and is not liable for any losses incurred as a result of failure to execute absentee bids or failed phone reservations. In case of identical bids, the first bid received will take precedence. Where appropriate, written bids will be rounded down to the nearest amount consistent with the auctioneer's bidding increments. NOTE: It is the bidder's responsibility to accurately record Lot Number and Bid Amount or Telephone number on any Absentee or On-Line bid form. C.A.E.S. assumes no responsibility or liability in the event a bidder fails to do so. Leaving an absentee or telephone bid indicates the bidder is willing to open the bid at one half the low estimate of the lot. Bids cannot be submitted, altered, or cancelled via voice mail or electronic messaging.
Estimated Weights and Measurements: Weights in catalog description have been estimated through measurement and are to be used as approximate guidelines and not relied on as exact. Unless otherwise stated, all stones have been measured and graded in their settings. Metal weight given for jewelry items with stones is inclusive of stone weight. Buyers are reminded that many colored gemstones have historically been treated to enhance their appearance. Clocks and Watches: No representation or warranty that any clock or watch is in working order is given. There is no guarantee to works or movements. Virtually all clocks and watches have been repaired in the course of their lifetime and may include parts not original to them.
Payment: All items purchased in person must be paid for on sale day. All items purchased via absentee or phone bid must be paid for within five business days of sale date. If a buyer fails to contact Chandler's Auctions and Estate Sales within three business days following the sale, the credit card used to secure the bid will be charged the amount of the invoice. For items purchased through Invaluable.com. or Auction Zip, Chandler's Auctions and Estate Sales will contact and send an invoice to all winning bidders via e-mail at the completion of the auction. If paying by check, Chandler's Auctions and Estate Sales reserves the right to hold the item(s) until the check has cleared. Payment can be made by cash, approved certified funds, Visa, and MC (credit card by phone or in gallery). International bidders are required to pay by wire transfer unless prior arrangements have been made. At the auctioneer's discretion, certain lots will be required to be paid for by wire transfer.
Ownership: Ownership of an item is conveyed immediately following the fall of the auctioneer's hammer. While Chandler's Auctions and Estate Sales try to handle and store all items with great care, Chandler's Auctions and Estate Sales will have no liability for any loss or damage to an item after the hammer has fallen.
Loading: Loading purchased items is the responsibility of the buyer. C.A.E.S. will, as a courtesy, assist with the loading following the sale, but this is done at the risk and responsibility of the buyer. Arrangements for pick-up for buyers who wish to supply their own labor can be scheduled during gallery business hours. C.A.E.S will have no liability for any damage while providing loading assistance.
Storage: Unless prior arrangements are made, pick-up within 10 working days of the auction is required, or a $10.00 per lot/per day storage fee will be charged.
Abandoned Property: Without prior arrangements in writing, any lot(s) remaining at The Gallery on First more than 30 calendar days after the auction purchase date will be considered abandoned and will be resold at auction to off-set the storage fees. C.A.E.S. is not obligated to notify the winning bidder that the abandoned lot(s) will be resold at auction.
Packing and Shipping: Chandler's Auctions and Estate Sales do not ship. Packing and shipping is buyer's responsibility.
